Florida season getting started!
    #25806393 -

Went hunting today after a nice tropical rain event. So far the best haul of the year!

Looks like you found Panaeolus cyanescens or a similar active Panaeolus sp.

Also the middle mushroom in your last picture is Psilocybe cubensis.

Nice find!

Edit.. you probably already knew that.

A few Psilocybe cubensis (the bottom 3) but mostly Copelandia cyanescens AKA Panaeolus cyanescens (the first 2 pictures).

If you get caught with magic mushrooms in Florida, do NOT at any time admit that you know what you have or your screwed. You can get off if you claim ignorance, but if you admit it at any time it's all over.

I only hunt on public land as well. There are plenty of places where you can hunt and not be trespassing .

I'm not talking about trespassing, I'm talking about possession of a schedule q drug.

I know doc, I know. If you do not trespass the police have no reason to search you.

Yeah, I've always figured that this is a pretty solid defense, provided you have a decent lawyer and no prior legal troubles.

As far as legal troubles and lawyers go, they have nothing to do with it, it is based on a ruling by the Florida supreme court in Fisk vs state of Florida.  The judges ruled that most people can't tell one mushroom from another, but if you admit that you knew, you are screwed.

Trespassing has nothing to do with it either, plenty of people have been arrested picking mushrooms in the states forest that allow grazing cattle and horses.

@breeg89 advised me to check out this thread if I wanted some guidance with hunting in SE Texas. The climate is similar, Florida, from what I can recall, is more tropical and probably receives more rainfall but this is probably the closest thread to what conditions are in my area. If anyone has any advice for a newbie on what to do and what not to do that would be neat-o burrito!

Solid advice...Never give up that you know anything about mushrooms  , or any other information other than that, and your identification.
You don't really even have to give up your identification unless you are a suspect in a crime, but the whole encounter will go smoother if you just act stupid and give up identification.

Ah I see - did not realize FL had that precedent. I was speaking more in general, without knowing state-specific laws and precedent.

Florida is the only state, I don't know if it would work in the other 49, but since it was a state supreme court ruling, other states may take it into consideration. I wouldn't admit to knowing shit about mushrooms, other than curiosity and the desire to find wild edibles.

I don't know about the US, but here in the UK magic mushrooms were made illegal in 2005, before which psilocybin was illegal, but magic mushrooms in their natural state, because of some loophole, were not illegal. However, as far as I can tell, from the time the law was changed, nobody in the UK has ever been successfully convicted of possession of magic mushrooms and I'm wondering why? The closest I can find on the internet is an American tourist that got a 'caution' which is basically nothing more than a warning, and a guy on this website who was caught in possession of magic mushrooms and cannabis, which he admitted, but was only charged with possession of cannabis. I wonder if anyone can explain why there are apparently no convictions?

Im not British but I’m guessing they passed the law just to get the fresh mushrooms off the open gray market.  Weren’t they sold in head shops under the moniker of being some kInd of “air freshener” before the ban?
