S. Jersey man faces a rare drug charge
Police said they seized a large quantity of "Foxy Methoxy," a little-known hallucinogen.

In the first such case in New Jersey, federal authorities yesterday charged an Atlantic County man with possessing a large amount of the hallucinogen "Foxy Methoxy," which is said to be similar to the designer drug ecstasy.

It was one of the largest such seizures in the nation, enough of the drug in powder form to produce 6,000 pills, Deputy U.S. Attorney Lee Solomon said.

Foxy is so new and seizures so rare that nationwide statistics are not readily available, Ed Childress, a spokesman for the federal Drug Enforcement Administration in Washington, said yesterday.

Every bit as rare, authorities said, is the manner in which they got hold of the drugs: The defendant, from Absecon, notified them and led them straight to the stash. The man is in federal custody and undergoing psychiatric evaluation.

Foxy began appearing at all-night dance parties in 1999, and municipal police departments began seizing small amounts in 2001. Only a handful of large seizures have followed.

The Atlantic County seizure was made during the summer of 2002, but the case remained sealed until federal authorities announced yesterday that a grand jury had indicted Michael James Gilbert, 21.

On July 23, 2002, according to court records, Gilbert called Egg Harbor Township police to report that he had been assaulted and robbed of 100 grams of Foxy. He reportedly told police that he did not believe Foxy was illegal.

Gilbert told police that he had bought the Foxy for $4,000 and planned to sell it for $8,000, authorities said. He then took police to a shed in Egg Harbor, where, he contended, the assault had taken place, according to authorities.

There, police said, they found a scale and a plastic bag with white powder inside. Next, authorities said, Gilbert "announced... that now that he had recovered his product, he no longer needed police services." He gathered his drugs and tried to leave, investigators said.

But the police kept the bag and turned it over to the DEA.

According to authorities, Gilbert telephoned the DEA five weeks later and asked for his drugs back, saying he had bought the Foxy on the Internet on consignment and owed $5,000. He also told a DEA agent he was eager to sell it because he expected a few thousand dollars in profit on the deal, authorities said.

Gilbert did not get his drugs back.

A few weeks later, authorities said, he tried again. On Oct. 9, Gilbert was arrested and charged with drug possession.

If convicted, Gilbert faces up to 20 years in prison and a $1 million fine. His bond was revoked, and he was sent to a federal facility for psychiatric evaluation, according to court records.

Gilbert's lawyer, assistant public defender Chris O'Malley, could not be reached for comment yesterday.

Because Foxy - also known as 5-MeO-DiPT - was not yet listed as one of the DEA's banned substances at the time of his arrest, Gilbert was charged under a broad federal statute that criminalizes designer drugs similar to ecstasy.

In April, the DEA added Foxy to its banned-substances list, calling it an "imminent hazard to public safety."

Foxy can be swallowed, snorted or smoked. Most users feel its hallucinogenic effects after about 20 minutes, according to federal authorities and the drug's advocates. The experience is said to include "feelings of love," euphoria and distress. Foxy's effects reportedly peak about 30 to 60 minutes later, then linger two to five hours.

"People on this drug might do things they would never dream of doing if of a right mind," Solomon said.

A leader of a New Jersey group advocating safe drug use at all-night dance parties said she believed Foxy use was rare.

"Not too many kids in the rave scene have tried experimenting with it," said Timmy, a 23-year-old involved in the group DanceSafe, who would give only her first name. "I heard about it about a year ago, but not so much now."

Richard Glen Boire, codirector and legal counsel for the Center for Cognitive Liberty and Ethics, which generally opposes drug prohibition, said the DEA had mistakenly classified the drug as harmful.

"These are not drugs of abuse," said Boire, who is based in Davis, Calif. "This is one of the classic drugs used by a small group of people, people who have a serious hobby of investigating consciousness."

According to authorities, Gilbert would appear to agree.

When he first contacted police, authorities said, he told them words to the effect that "hallucinogens are an important part of life, are useful in expanding one's altered state of consciousness, have a psychic effect, and allow one to communicate with one's inner self."

Couldent have said it better raadt, you can kill someone, and get less time that if you sold drugs, I geuss they figure that you will kill people with the drugs, so its harsher, dumbasses.

This is fucked up.The analog laws are so vague that they could arrest you for anything it seems.

And what's this psychiatric evaluation bullshit? How dare you experiment with drugs that produce empathy and kindness,so we're going to reprogram you!

Pretty soon,they're probably going to arrest people with any carbon containing compounds that the powers that be don't deem suitable.
