NY Governor Cuomo Reaffirms Commitment to Marijuana Decriminalization

#17525211 - 01/10/13 12:08 AM (13 years, 9 months ago)

Man... old foggies like me will be reminded of the Berlin wall coming down...

Basically in NY state there's this kluge where possession of less than 25 grams is a just a civil violation, but possession of 15 grams "in public view" is still a mister meaner. What's "in public view" you ask, grasshopper? Well, basically if you're walkin' around and an officer has "probable cause" to terry frisk you (read, you're black or hispanic), and finds you in possession, then you get bit by the "public view" clause, and welcome to the plantations, 'cuz you've got an arrest record.

In his State of the State address, delivered this morning, New York Governor Andrew Cuomo reaffirmed his commitment to reforming his state’s marijuana laws. The governor proposed decriminalizing the possession of 15 grams of marijuana in public view to a civil violation. Currently only possession of marijuana in private is decriminalized, possession in public view is still currently a Class B misdemeanor punishable by a fine of $250 with a maximum sentence of 90 days.

“These arrests stigmatize, they criminalize, they create a permanent record. It’s not fair, it’s not right, it must end and it must end now,” Governor Cuomo stated.

"Officer, I'm going to remain silent, and I would like to speak with a lawyer. I'm not resisting, but I don't consent to any searches.

It's time. This "war" has already overstayed it's welcome by decades.
