Plagiarism help

So Im about to step up into the art world and wondering what ur opinion would
be on Plagiarism of artworks. So many people use for example Mickey Mouse or well
known figures as well as movies stars and musician's photography in their work.

I had some ideas that revolve around printing off some images of say...
Some random porn star and editing the image in photoshop and then printing that
off and pasting the image to canvas or whatever and then painting over that to
make it my own and or unique while looking a lot different to say the least.

My question would be is that ripping off someone's photography?? Should I hunt
down the photographer and ask for permission?? I just do not know how to go about
this.

BTW forgery might not be the word im looking for but IDK lol.
I guess it depends on if the images are copyrighted :shrug:

I'm pretty sure-- especially with a lot of classier pornstar images-- the images are copyrighted and cannot be used without permission from the photographer.

I'd imagine big works of art and especially symbolic characters (e.g. Mickey Mouse) are the same.

Yeah. You'd technically be "stealing" and could get sued.

If you wanted to incorporate someone else's work into your own, you'd have to track them down, and get their permission on paper.

My aunt is a photographer, and she used someone else picture in one of her collages once, and it got published, and one of the other photographers noticed their picture was in there, mind you it was like an inch by an inch, guy freaked out, sued. It was a huge mess. He took like 60% of the profit, she made from it.

Don't take risks like that! Just get creative, and try to get your own work.

What about the artists that use company logos and such in their work
like Mcdonalds and shit and are clearly shinning a terrible light on that
company. How do they not get sued?

I think that most fan art work is not sold and therefore is not technically copyright infringement? If you intend to sell your art I think it becomes a lot more relevant.

The stuff Im talking about deff gets sold and for a shit ton.

Of course I cant find examples right now.

Well that looks painted from the ground up... it isn't really the same thing if you're taking an idea and redrawing it from scratch... definitely a grey area there..

Yeah, I'm sure there is something to be said about it but it is probably like other plagiarism rules where you must change seven aspects of the piece to make it original, basically... ie, mickey's face not being black, no ears, marylin monroe having real breast and not mickey faces, etc. etc.

Also, while Mickey is technically a copyrighted entity, I'm not sure real people qualify as such.(MM)
