Mints Believed To Be Crack Land Man In Jail [FL]

Don't bring mints to Florida. You may end up in jail, losing everything you own in the process.

KISSIMMEE, Fla. -- A man is suing the Kissimmee Police Department for an arrest over mints. When officers pulled Donald May over for an expired tag, they thought the mints he was chewing were crack and arrested him.

May told Eyewitness News they wouldn't let him out of jail for three months until tests proved the so-called drugs were candy.

May said he was just minding his business, driving home from work, when a Kissimmee police officer pulled him over near 192.

"I don't know how it occurred," he said.

May was pulled over for an expired tag on his car. When the officer walked up to him, he noticed something white in May's mouth. May said it was breath mints, but the officer thought it was crack cocaine.

"He took them out of my mouth and put them in a baggy and locked me up [for] possession of cocaine and tampering with evidence," May explained.

The officer claimed he field-tested the evidence and it tested positive for drugs. The officer said he saw May buying drugs while he was stopped at an intersection. He also stated in his report May waived his Miranda rights and voluntarily admitted to buying drugs.

May said that never happened.

"My client never admitted he purchased crack cocaine. Why would he say that?" attorney Adam Sudbury said.

May was thrown in jail and was unable to bond out for three months. He didn't get out until he received a letter from the Florida Department of Law Enforcement and the State Attorney's Office that test results showed no drugs were found.

"While I was sitting in jail I lost my apartment. I lost everything," he said.

While May was behind bars, the Kissimmee Police Department towed his car and auctioned it off. He lost his job and was evicted. Now May is suing the city for false arrest and false imprisonment. He wants to be compensated for the loss of his car and job.

May's attorney and the city of Kissimmee discussed a possible settlement last year, but failed to reach an agreement.

I mean, damn, what other conclusion could the officer have come to?
Some dude driving a car alone at night chewing little white mints? Well he's obviously druggie scum and those are obviously crack-mints he's chewing.

This is an excellent reason (as if I didn't already have enough) for me never to visit Florida, at least as long as I'm still sucking on nicotine lozenges. Although, given that it's an actual addictive drug that they approve of, I'll be okay.

also, I'd agree, the idea of eating ones' crack seems a bit odd, although I guess they could argue that he was eating the evidence or something along those lines.

I wonder how well crack chewing gum would work.

This story wreaks of bullshit.  Compensate the man already.

People transport crack in their mouth very often.  However, at the same time, many people chew mints, nicotine gum, and many other things that are small and candy like.

That dude got worked.  Hopefully he ends up on top after suing.

Hell yeah, I hope he gets enough money to get a new car, buy a home (since he lost his apt.) and so that he doesn't have to work for the rest of his life, since he lost his job too and we all know how next to impossible it is to get a job now a days, especially at this mans age and with a felony on his record probably. No, if true restitution is to be offered, then that cop should have to go to jail for the same amount of time as the wrongfully imprisoned person had to endure or at least loose his job for obviously lying about it testing positive for "crack cocaine". I mean, he claimed that the field test kit tested the substance taken from the mans mouth as positive for crack cocaine, that was obviously a lie to make the arrest stick and an abuse of power on the cops behalf.

Man I wish I was the lawyer on this case, that'd be sweeeeet!

I've also had cops file blatantly false reports. Once time I demanded (through my attorney) to get the video tape from the cop car, and all of a sudden they say they can't find it...

That's the thing about Florida, it truly is a southern justice state.
I've got a friend in jail right now, he's black. He was arrested for
violating a restraining order. The restraining order was filed, because
my friend was dating a white supremacists daughter.

She called him, asking that he visit her, so he came over. The father shot him and my friend was arrested. He's facing 25 years.

Tell me that ain't fucked.

man this is outrageous. did anybody see the article someone put up a few months ago about police field tests getting false positives? i think chocolate and parsley tested positive for thc, and maybe tylenol tested positive for cocaine im not sure. that could have been what happened in this case. they need to stop using field tests obviously. i hope this dude gets hooked up.

exactly.


Florida is easily one of the most fucked up states as far as criminal justice goes.  Their drug policies are obscene, and they have a history of immoral justice system practices.


(Florida was the state that finally fucked up enough to get the supreme court to rule you need counsel for nontrivial criminal matters if the defendant can't afford it himself.... after most states had been doing so for years)



It is totally disgusting that they would jail someone on the basis of those reagent tests.  It would have taken no time at all to do some proper tests that could actually support probable cause.



Why the fuck is anyone in jail for three months for crack anyways?  Even if the guy was sentenced that would be obscene.


(oh no, an adult minding his own buisness posseses a particular chemical we don't want him to.... lets kidnap him and take everything he owns)
