Ya, I'm drawing right now. They recently raised my unemployment because of some federal bill and then raised it more because of a state bill.

so you can't get it if you're fired? i got fired from red robin [burger joint] for not doing the patented greeting bullshit [fucking BULLSHIT! no one did that fucking greeting unless a manager was standing and listening, that place was such a fucking shithole to work in the manager was a troll of a bitch]. anywho - what's really shitty is that i've been working for my brother at his auto repair shop and i accumulated about 50 hours and he thinks it's more like 20 and since he's too pathetic to even keep track of my hours the burden of proof is on me. im betting ill never get that money. even my own brother shafts me :thumbdown:

Well probably...

Since you live in the same state as me I can tell you that directly disobeying an order from a superior, even if it's a dumb greeting could be construed as misconduct. However, the burden of proof is on your employer so it would be up to you weather or not to try and file.

To be honest, what I got fired for WAS misconduct, but I took the gamble that my former employer was incompetent, and I turned out to be correct, so I won my case.

Probably not good enough excuse to try and collect UE . If you got fired for not getting along with a co-worker say one had an affair with your wife and you cussed him out told everyone to fuck off you would have a better chance.  Being forced to work with someone who treats you like shit or did something to you and causes you to snap is  better grounds to file a claim than refusing to do part of your job.

i wasn't refusing to do it, it was finals week and i was sort of spacing thinking about a test i had later in the day and forgot to do it and bam fired. i can see what you guys are saying though, i still find it INCREDIBLY petty to be fired over. you guys speak as if you'll get some sorta penalty if you don't get UE and the employer proves you wrong? or am i misinterpreting

It is petty but it comes down to maintaining company policy sometimes people get put int a position to have to fire someone even when they don't want to, bosses have bosses who have bosses.

that's true. i dunno, i think i was just being made an example of. there was a new manager who wanted her presence known and feared, she fear mongered everyone and i was maybe a symbol of rebellion or some shit. w/e fuck that shit hole rather spend my unemployed ass out in the sun having fun

If you start collecting and it's later proven that you were fired for misconduct through employer appeals then you have to pay it all back.
