Failed felony probation piss test..

For the first time ever, been on probation 5+ years now and finally fucked up and failed one. I was positive for weed, been clean for almost 30 days and still failed..any ideas what kind of trouble this is going to cause? I denied denied denied but the probation officer has heard the story thousands of times before, so it didn't really do any good to convince them otherwise. This happened in TX. Any advice is appreciated, I don't know what to expect now. If I get my probation revoked I'll be sentenced to 10 yrs in prison.

Keep bitching, demand to retake the test... I KNOW you are allowed to retake the test. Not all tests are 100% all the time.

False positives do happen!!!

If this is your first failed test in 5 years of being on probation you will be able to use that in your favor. Hell, if it comes down to it go take a test on your own time. I did this at the reference lab at our hospital. You can ask them to print out the results and then when it comes time to go to court you tell them it was bullshit that you failed in the first place, and when the officer denied your right to retake the test you went and took it on your own to prove he is wrong.


If you have been clean for 30 days, passing a test should not be a problem.

You need to take my advice and go take a piss test on your own time now. They cost under 30 bucks, I had the option of a 5 panel, or a 7 panel. I took the 7 just for the hell of it. Shows that I was clean from everything they test for. You will have to go to court before going to jail... So you bring they results with you and present them to the judge. The judge is NOT going to fuck you over on this for two reasons.

One, you have pissed clean for 5 years. Thats a LONG ass time!!!

Two, you will have done something that not many people do. Challenged the officer on a false positive, and when he denied your right to a retest, you said thats bullshit and took one on your own time. This needs to be done at a Hospital, or someplace other then home drug tests.

This is exactly what I did, and they judge took my side on it.
Do this, and I almost promise you will be fine... But damn, I still think its amazing they denied you a retest. I am pretty sure it is your right here in WI to retake a drug test. Texas must just really like to fuck people over, as we all know.

Thanks man. Do I just walk in and ask for one or what? The problem is, I AM positive because I DID smoke, so the hospital test will probably show up positive also. In that case, I wouldn't want to show the judge. What a fucked up situation this is. My stomach is aching because of the stress this has put on me. If I knew I would test neg, I would go to the hospital and have them test me as proof, but that's not the case at all.

How long has it been since your failed test? What about going out and buying one of those liquid bullshit pass a drug test kit and go take it? I don't trust them, but it cant hurt

I guess the thing that blows my minds is that you fail after that long!!

You should not be failing for thc after a month. Thats rare!

What I would do is wait 24 hours... Drink TONS of water, like SHITLOADs of water, tea, whatever. Dilute your system up until like 5 hours before the test. Then go in and piss. But stop drinking water awhile before the test. I'm pretty sure they can tell if the urine is extremely diluted.

Two things that can help is: don't use the first piss of the morning, and when you start pissing, don't use the first piss that comes out.--Cut into the stream midway... I did quite a bit of research on this back in the day of High school. I was facing being expelled. So failing was not an option. I ended up going with synthetic urine--fool proof... But it is a little to late for you to order.

And going in and taking a test on your own time is still a good idea. If you pass, Great, you can use it and probably get out of everything. If you fail, you just throw the fucking thing away. Just go to your local hospital and tell them you want to take a urine test. They wont ask questions... They will only ask if it is for work, school, or neither. Everything is confidential, unless you sign something that tells them they can send it to whoever. Just tell them it is for yourself. If need be make up some stupid excuse.. You think someone drugged you the other night and want to see if you test positive for anything. It really doesn't matter, it is 100% confidential.

I appreciate all the advice. I thought I was in the clear, but apparently there was still some metabolites left in my system. 27 fuckin days! I will do the hospital thing after drinking a ton of water and hopefully that will gain me some leverage if I have to go to court / jail over this. What a fucking bad day this has been. And yeah, 5 god damn years and I've never failed a test up until now.

Let me know how it goes... I know how stressful all this shit can be... I was facing being kicked out of school... And with both parents being teachers, that was not an option.

I really think you will be OK if you drink water and take the test again.. It is straight up bullshit that you failed after 27 days! I know plenty of people who have passed after a week or two.

And if all else fails, I dont think you will get jail for this... Like you said, you have pissed clean for 5 years. When it comes down to it that is going to be a HUGE factor in what happens. A judge would have to be one cold motherfucker to screw you on that. Just deni deni deni. You aren't going to go to jail either way... Maybe they will just fuck you with extending your probation.

I Texas they will not give you a retest, but will put you up for treatment on the first offense, inpatient treatment on the second and a hearing for the third offense.

Sounds like jail will not be an option.

They also say to tell them any scripts that you are on anytime during probation in case it might cause a false positive.


This info is just FYI for anyone doing a search in the future.

I would go take that hospital test. There are also probably several other testing centers in your area. You might try calling a drug testing workplace and see where they have theirs done.

After almost a month there is no way you should have failed. Two weeks did me fine, and I was a pretty heavy smoker who made little attempt to clean myself out. I did increase my water intake and took a few niacin pills here and there.

Your test was a false positive. Who knows why, but I would aggressively try and defend yourself. Sometimes probation violations can be pretty serious. If you've got 10 years hanging over you that really sucks. If your PO wants to go to the judge and say you've violated your probation you might be in some serious trouble.

I'm not trying to scare you, it will probably turn out to be nothing, but some judges can be real dicks when it comes to probation violations. Most probably won't take just one failed UA all that seriously. I was on probation once and the PO usually gave people one dirty UA before doing anything. First failure was simply closer supervision during probation. The second one and you were violated. Of course, he didn't tell people about this policy until you failed one. Then he got to act like he was such a nice guy for giving you a second chance.

I would just ask him what's going to happen from it. Once you find out what he plans to do you'll be in a better position to figure out what you should do.

Thanks fred, yeah I read that story..fucked up stuff! I've played by all the rules and always made my payments on time, so I'm going to ring the po up and ask what to expect. I appreciate all the input everyone in this thread has given, it helped calm me down a little.

did they run the sample through a GCMS machine to confirm? i thought they did that in these circumstances.

It was a simple 5 panel dipstick test, I watched them do the entire thing through the glass window. There was no GC/MS present at the testing facility. I had a feeling I was fucked, because usually they take a minute and then tell me I'm clean. The lady sat there for a solid 3 minutes before asking me if my probation officer knew I was positive for THC. I just hope I can get through this one fuck up without doing prison time. I got a family to raise. I'm staying clean for a long time.

Is say its time to get up close and personal with your PO and kiss some ass. Deny, deny, deny and point out that for 5 yrs youve been clean and that a prescribed medication youve been taking is known to cause false positives. This person holds your future in their hands. Dont run from them at all unless you plan on goin on the lamb. Id take the initiative and call them ASAP to plead my case.

Yeah man I'm going to give my po a ring very soon and tell them my findings that a med I was prescribed can cause a false pos. It's my only hope right now of avoiding any serious repercussions I think. I am definitely not going to be passive about this issue, I've got too much to lose. It was my own damn fault for lighting up when I knew there was a possibility of a drug test in the near future. I just can't believe it finally caught up to me after all these years.

10 years is a long fucking time, hopefully you can get it worked out. I hate to say it but cheer up though, who knows what will happen. One time I had a year in DOC hanging over my head (DUI) and I failed a drug test and went on the lamb. After about three months of running I turned myself in and all they did was extend my probation 3 months :smile:, really you dont know what theyre gunna do.

EDIT: In my case is was all about what the probation officer wanted to do, the judge and prosecution went along with whatever she wanted. I ran to AA meetings though (on her recommendation) before I had to goto court for it. They seemed to like that.

This is my best recommendation for the future... I don't believe in the government controlling my actions. What I choose to do is my own fucking business. This system has worked for me over 8 piss tests. Most of them my senior year in High school, but I also had two for jobs.

They can do a hair test. You have to pay for it. The only way out. I'm on probation in Texas too. A friend of mine beat it this way. He does not do do drugs. Good Luck.
