græmlin images & copyrights?

i was thinking, what exactly is the standard rule in terms of sharing/stealing of græmlins from other sites? for the most part, i'm sure people tend not to care one way or another - i highly doubt any online community would spend the time and money needed to legally "protect" their græmlins - but do they tend to fall under free public domain unless otherwise specified?

in particular, i wanted to upload this dancing græmlin -  - as our current dancing græmlin - :dancing: - looks like it's doing a tweaked out raver type dance, instead of some smooth getting down to bobby type dance. i guess i could just get in touch with the admins at ratdog.org (where that græmlin is from) and see if they'd mind if we used it, but i was also just wondering in general, if anybody knows how legality & copyright works with græmlin images...

Well most of the time, the smileys we add have been around the web and there's no real way to ascertain their origin. In those cases we'll put them up, but if someone contacts us to assert ownership we'll take them down. If you know who created a smiley though, you should get permission from them before we add it to the BB.

A smiley is a work of art, just like a picture. On the Internet your creations are automatically protected by copyright, except in cases where it is given up into the public domain explicitly.

If we would add MSN's blushing smilie to our smiley panel, chances are quite real that we would be sued. But if :crankey:  were made by an individual and never released into the public domain, he as an individual could sue us also.

OTD's use of crankey by no means constitutes fair use :crankey:
Most artists are reasonable, but some are not.

So it all depends on permissions. Copyright is the default, public domain is the exception.

I say "gRAYmlin", but according to this document the ae digraph is generally an e sound (for biological latin, which this is not).
