 Judge Throws Out Marijuana Proponents' Challenge

(AP) DENVER Supporters of an initiative that would legalize possession of small amounts of marijuana lost their bid Wednesday to block the state from distributing a voters guide they said is meant to frighten voters into opposing the measure.
District Court Judge John McMullen said he didn't have the authority to interfere with the legislative process and said state law gives lawmakers wide latitude when they vote on legislative issues. He said that includes language in a voter guide explaining initiatives on the November ballot.
McMullen said state law allows people to challenge new laws after they pass.
Mason Tvert, campaign director for Safer Alternative for Enjoyable Recreation, said the voter guide incorrectly claimed the initiative would allow people to transfer up to one ounce of marijuana to juveniles 15 and older as long as there is no compensation. The voter guide notes that possession for people under 21 would still be illegal.
Tvert said the marijuana initiative would not change current state laws that bar contributing to the delinquency of a minor and make distribution of any amount of marijuana to minors under age 18 a felony.
Tvert's attorney, Robert Corry, told McMullen that judges have the right to intervene if voters are being misled. He said the damage would already have been done if Tvert is forced to wait until after the election to file a challenge.
"This court is not powerless to address important issues," Corry said.
Richard Kaufman, who represented state lawmakers and officials who wrote the analysis based on comments from supporters and opponents of the initiative, said the voter guide was approved by lawmakers, and courts have ruled that it would violate the separation of powers to try to overturn their decisions.
Tvert said he has not decided whether to appeal the decision. He said state law also provides for criminal penalties for trying to mislead voters and he might ask for an investigation.

Thats fucking bullshit the legislators said it wasn't their job to change it and its not the judges job to change it so who the fuck is going to change it?!
