I'm 26 and I've never had my car involved in an accident until last week so I'm looking for a little advice.
I let my g/f borrow my car on Friday afternoon. She was turning off of a parkway into the parking lot around 1:30pm into the post office when some 16 year old rich chick in her daddy's volvo plowed into the back of her doing around 40mph-ish.
We have a witness that gave my g/f her number saying she saw the whole thing and would testify on our behalf if needed. I came to the scene of the accident a few minutes later. The brat's even brattier 16 year old boyfriend rolled up a few minutes later in his !!BMW!! and started giving me some lip. My g/f and I put him in his place and he finally backed down. A deputy showed up. the 16 year old brat admitted to him that she rear ended her. He said because of this and because no one was hurt, he didn't need to file a complaint. I got his name anyways.
My insurance company determined that we're not at fault, but due to the fact that I have a $1000 deductable and it wasn't my g/f's fault, I decided to go through the spoiled brat's dad's insurance company so I could get them to pay for everything. Geico said I could either do this or I could just go through Geico, pay the 1000 deductable and they could TRY (but not garuntee) to get the 1000 backs. Screw that. I'll go though THEIR company.
The responsibly party's insurance company called me around 4pm while I was waiting in the doctor's office waiting room. My g/f couldn't get to the phone, she was being seen by a doc. Her neck was hurting a little bit. She has a follow up appt next week, but all in all her medical bills are probably only around 100 bucks.
THEIR insurance company is slacking. Not only could we not get in touch with a claims specialist over the weekend which caused us a huge pain because I needed a rental car (this is why I stick with geico, specialists 24-7). It's Tuesday afternoon and my g/f keeps calling the specialist of the other insurance company to explained what happened, but they still havent' called back and haven't even determined liability. The problem is it's been since Friday and my g/f has been constantly calling, leaving v/m's with their claims specialist and she's totally dragging her heels. Not a single call back
I called the repair place, and they said THEIR adjuster looked at the car today.
Due to the nature of the accident, the damage to the FRONT of their car and the BACK of mine, the fact that we have a witness, etc I'm pretty sure there's no way they can deny responsibility, but you guys know how insurance companies are when THEY"re the ones that have to dish out the $$$.
The chick's dad seemed cool on Friday when I talked to him over the phone a few times. He said he was really sorry this happened. I told him that I was really just glad his daughter wasn't hurt and that I just wanted to get this over with asap and put it behind us. He concurred.
Today I started a 5 day vacation. The brat's mom wakes me up at 8am because she needed some info to fill out this report with the DMV that she has to do by law. My g/f is covered on my insurance, but I think the dumb bitch doesn't have any idea how insurance works because she kept asking for my g/f's insurance policy #, not mine even though I kept trying to explain to her she was COVERED ON MY INSURANCE.
The bitch didn't get it and starts saying my g/f was driving without insurance and implies that we were at fault. I raised my voice to her (still grumpy from being woken up and now this) saying "YOUR DAUGHTER REAR ENDED MY CAR AND IT's MY FAULT?!?!?!". She backs off and starts yelling at me "IT WAS AN ACCIDENT! ACCIDENT! WHY ARE YOU GETTING AN ATTITUDE WITH ME". I tell her my g/f is running errands (she's really still asleep) and I'll have her call her back. I didn't mean to scare her, but it sounded like she was about to cry.
I guess the stupid bitch wife goes back to her husband who USED TO BE CHILL and tells him that I'm a dickhead that screamed at her for no reason because he calls back to get this info a few hours later. I put my g/f on (the one who was REALLY affected by all this). Apparently he starts copping an attitude with her now when he's trying to get the info to fill out this form. They start yelling at each other and she basically tells him to kiss off (in more or less words) and she's not giving him any more info.
Despite the overwhelming evidence, I have the feeling because of all this that the parents mights find some way to drag this out as long as possible.
Has anyone been in this situation before? I get back from vacation this saturday (about a week after the accident). If there isn't any progress by that Monday I'm thinking about threatening a law suit against them.
I hate law suits. I'm a modest person and I don't believe in taking any more money out of a situation like this than what is neccessary to pay the bills. My ethics prevent me from taking advantage of situations... but if they're going to start being complete dickheads and making it REALLY inconvenient to get my car repaired.. I'm thinking about getting really nasty. I know my g/f's neck is ok, but just to be a dick I might go to a chiropracter (sp?) and then dangle that in front of them just to scare them into complying as fast as possible.
All I want is my car back and fucking fixed. It's probably only about 1500 dollars worth of damage anyways.
