reporting employer to state? everyones thoughts.
    #5352354 -

my girlfriend was unfairly fired from her job. her employer operates illegally paying employees and such under the table. she wants to report the employer to someone - ie fuck them over the same they did to her.

what happened:
she missed one day due to car problems, called one supervisor, who in-turn never talked to the other supervisor to communicate her problem. she fixed the problem has record of the repair and even volunteered to come an hour late for her shift when she could get a ride. she shows up for work exactly on time yesterday and she walks in and is fired. her boss said he would rehire, but the replacement stays and she waits for someone to quit. after talking with the other supervisor the firing supervisor admitted being wrong and it was a LACK of communication and she is still out of job but not 'fired'. While my girlfriend called them 2 times Monday as her cell phone indicates and they never called here once.

what they are doing illegally: paying cash without tax deductions, not workmans comp or any insurance for that matter, and probably not paying taxes on the incoming money either. she has already been paid cash for her services up-to-date.

i told her to cool off and think about a few days as we are fucking with peoples lives here. what are your views on this? will we put other people that work there out of job possibly? will he actually even be penalized or is it a joke? who would you call to report this, OSHA? some Federal agency? or State level?

thanks for all your responses/advice in advance.

most states are 'right to work' states, they can fire you for having fingernails
or for showing up on time every day

cool your jets, all boss man has to do is send her a 1099 and she'll be paying
taxes, responsible for her own workmans comp and since it's cash, the boss
can claim he paid 3x the real amount and nothing you guys can do about it
except try and pay the taxes for much more than she earned.

ummm... document that for me. sounds like bullshit no offense. everything will have to proven one way or another I am sure.

well it has been a long employment relationship of 2+ years. no 1099's ever filed explain that. we know he is not paying state income taxes on his incoming and they are bringing in large amounts of money... maybe $20-30k monthly.. we figured his payroll alone monthy must be $12-14k. he has actually bragged about not paying taxes.

and this is a 'right to work' state. we already knew that. we are not contesting this is about vigilance at this point.

what records are kept by your GF that document what she's making, the period of
time she's been working there, etc... I've seen it done before in construction
when someone decide to make too many waves the former employer retaliates
generaly the Dept of Labor just sdays theres nothing they an do without him
running his shit as it's supposed to be because theres no proof the they even
worked for the company

how the hell am I supposed to documant anyhthing witha little 'he says, she says'

no 1099 doesnt explain anything, all he has to do is send one to her and one to the statewith her name, the process starts there

then you should know that there is no real recourse, your GF was fired, she
needs to look for another job, you can try to make lots of trouble for the guy
but whats going to happen in the long run, you may put dozens of others uot of
work, ready to accept the responsibility of that.

we have reported this income on taxes already... i have a nice honest girl. she has regularly depositted most of her cash every two weeks when she is paid. so her deposit records would show something as well.

this is a part time job and no a huge deal, the extra income was going towards her new car.

i agree on him being a bad employer. you don't cut an employee of two years for missing one excused day because of miscommunication between management. she even went in and worked two days off last week for another employee - i can see why she is pissed about the situation, she has been a good employee to them.

i've also seen in construction OSHA come and hit a framing contractor for a huge fine supposely for something a former employee reported. they caught him breaking some major safety violations and fined him like $10k.

Fuck them over. Don't think twice about it. Assholes need to burn in hell.

My g/f and I work at the same place. They lie and cheat their clients. We have lots of proof we're stocking up. They treat her like shit. If they ever try anything shady with her... we're give it all to the clients.

state is Colorado.

lying and cheating is legal if you do it right too.

i just don't appreciate the snitching aspect of the whole matter.

we have a nice life and doing things like this could disturb it.

Let it go and tell her just to get a new job.

Trust me, it isn't worth the stress. A long time ago we tried to bring the union into where I used to work. We lost the vote by one, who we know now was paid off, vote.

Everyone involved lost theit jobs. I was in a position that gave me time to find another job before they pulled the get the fuck out of here card on me.

The stress of the whole thing wasn't worth the outcome.

Every law the employer breaks puts the employee at risks.

No insurance? Shit, someone gets hurt it will be hell to get covered and taken care of while you tie up a lawsuit in court.

Not paying taxes? the IRS comes along and fucks BOTH parties!

etc.

you can call your states labor board and report it anonymously..

in some cases they will go back 3 years and recover lost pay for all employees

if nothing else he'll have to get legit if he isn't with his pay

forget it, they might even rehire her real quick. the turnover is kind of high that is why it funny they would fire a long time employee so fast.

now the question is do you go back if asked?
