Please Help me, terrified of court. . .

alrite well, i got a underage drinking charge, errr another one i mean. This will be my second, the first i was not even drunk i just took responsibility for letting drunk kids stay at my house (yea im such a bad person, they were at my grad party on the lake, they came off the lake wasted, so i took them home so they dont do anything stupid). Well they got a little rowdy for 5 mins, but stopped and went inside. Turns out my prick neighbor called a noise complaint. . .at 9 45 p.m (kurfews 10 or 11 round here). And just b/c my neighbor mentioned how i had a party earlier, i became the suspect for getting those kids drunk. Fucked up shit. . .i was being a good friend, and i wasnt even drunk. . .
Anyway I got another charge. . .and this one again involved a Cop doing his job very poorly. I blew a .07 on the breathaliser, but im gonna ask the court/cop for papers prooving when the last time they calibrated the breathaliser. The reason i will ask this is becuase im going to put the cop on the spot, he breathalised many other underagers who failed, but he let them all go except a couple of us (we were being well behaved too, i dunno what this pigs problem was. I was too scared to talk outta line, i had a bowl in my pocket). Anyway he let us all go party more, he even said "yea youre here at Pennstate, sorry for busting up your party, you'll find many more, prolly better, so go have fun, you cant get in trouble for it twice". At the time i thought it was cool of him, but noooo. . .it wasnt. My friend who i mentioned the cop let go ended up driving that nite, almost caused an accident. Then got out of the car when he arrived to his destination, and started wrestling with his friend that was with him, and they ended up fighting and one of them kicked the car and fucked shit up, huuuuuuuge dent.
I dunno i was wondering has anyone ever been able to get outta underage drinking charges? Im going to mention how im going to Marine Mechanical institute, and if i lose my liscence for a year that means i cant drive the boats at school during classes. Also i dont know how im gonna get down to FL from PA, and how im gonna be able to get a job and whatnot (second charge doesnt allow you to get an occupational liscence). does anyone think i can trade mr judge for some community service, or am i "screwed".

i mean if i do lose my liscence ill just trade my Subaru Svx in for a CBR (cops cant catch, find, spike strip, road block, or do anything to catch a streetbike, and if i were to crash into an innocent car, id only kill myself. . .no biggie). But id rather have my car for the time being. If not ohhh man im gonna be sooo illegal on my streetbike, no liscence or anything, too fast, too furious. Soooo yea, help me keep my car, if i die, no place better than on a bike, but i dont quite wanna die yet.

Your post is way too big to read man. I read the bottom part that basically states you've got a ticket for underage drinking or something and you're going to court to dispute it. First off, doing the guilt thing won't work with the judge. If you want to get out of the ticket lie and deny. Deny everything. Never tell the truth. You were not drunk, they have no proof, don't admit to anything. Just flat out lie. They won't give you any mercy for being an honest person.

Often stuff like this gets thrown out of court because of lack of evidence or the officer doesn't show up. So just be cool, relax, life goes on.

Hell yea im gonna deny till the end, but if they say breathaliser is proof, what do i do? change my gameplan a little bit.

So you're being charged with a DWI on top of being underage and drunk? You didnt really specify what happened.

yea breathalised me once. And no i didnt get a DWI, just underage. im not some moron whod drive a vehicle intoxicated, well stoned. . .yea i would, i drive like a champ high. . . but lets not start a debate.

If they only breathalized you once tell them you have no idea why it gave a positive reading and that you had just brushed and mouthwashed your teeth before because you were trying to hit on a girl. They should have breathalized you twice, 20 minutes apart, I'm pretty sure. But just claim it's mouthwash.

respect? they dont respect me i was drinking responsibly. . .Fuck laws its not my fault other morons abused my god given rights and made them "illegal". Intoxication is a right no man shall be denied. . .unless hes a fucking idiot or endangering the lives of others. And no, they wont catch a CBR, unless it crashes. . . you're funny tho. FUCK THE PO (in this case). But i do respect them as long as they dont bother responsible, innocent people. For example if i wanna smoke weed or Drink alllllll day on my property, and do so indide shut out from the world. Its none of their business, plain and simple. My family paid for the land we reside on top of, therefore im gonna grow w/e i want in my house, smoke w/e i want, but if i step into their world i understand im on their time now. . .

is it a small town man? if its a a big enough city then you have good chance of getting off if its small or county cops in a small county then dont count on it. and dude dont go run from teh cops on a bike my buddy did that and later on they saw the bike and brought him in court anyways and the judge sided with the cops.

If you go court appointed your going to get fucked around with. if you have enough money to actually fight it then you might get it thrown out. you have to understand they will want to put you on probation or somehitn similar because that is how they make their money of us poor small time offenders, i got caught with one joint, and that one little joint is going end up costing me over 1000$ 90 hours of community service(which i can buy off at 6.15$ an hour belive it or not) and 9 months of not being high. of course this is Texas. all my point is everytime they can pop a young kid for drugs or alcohol they will usually make examples out of you because in their eyes they are doing a good thing for one i cleaning u up and 2 its a good way to make quick cash for the state its what the founding fathers called TAXATION WITHOUT REPRESENTATION.

if you lose you liscense seriously dont go get yourself killed just to avoid the cops man its not worth it. whatever they give you will be over before you know it and afterwards then you can get on with whatever plans you have, take the time they give away your liscense to do whatever just dont get in trouble try to make it productive.

Doc is right Lie your ass off to cops and judges if you go on probation see if the PO is cool or not(yea there are some cool ones) and if they are then you can usually be more honest with them. My buddies is a chick and he will just tell her if he will test dirty or not and she wont test him when he says he'll be dirty because she recognizes that he has made immense improvements in himself. Of course he lies to her a little in that he says hes just a pot head when he really does just about everything. Anyways your PO and you will have a more lasting relationship than the rest of the fucks in teh system, so try not to piss them off. Peace

Thanks DocPsilo. . .good idea. I really think i can get them w/the calibration of the breathaliser shit too, the cop would be like uhhh. . . uhhhh. . . i quit my job im a piece of shit. . .lol. It is REALLY WRONG to let one person go for the same thing anothers getting in trouble for, especially right in front of my face.

You're going to lose your license. They will get calibration records and accuracy checks of the breath machine used. If they show up as accurate, you're fucked.

Yeah man. Good luck. Just be creative and use ANY discrepency in the cops story to put doubt in the mind of the judge. ANYTHING man. From where/when it happened, to how it happened, to your description, to the breathalizer reading. If he claims he knows it wasn't mouthwash because he smelled alcohol claim that your friends had been drinking. You're not guilty through association.

Again, best of luck. You've got a huge chance of walking away scott free, man.

Yea it was a large city blaze, i think ill be good thats why i really wanna make sure im prepared. You know you brought up a lot of good points, its rediculous how much control government has over those who ignore it and have realised its evil and just people trying to make money and names for themselves. But. . . Like i really care what other people do anyway, i worry about taking care of myself not others. Im just shocked i got caught, i guess cuz it was new turf for me. But point is, If i wanna smoke weed im going to, its NOT a crime. If i wanna drink (which i dont even do anymore) im gonna, i know how to handle myself. Thanks to anyone who cant for fucking it up for the rest of us JACKASSES why cant you kill yourselves instead of my fun.

the worse thing that could happen from an underage would be like a weekend in jail.

show up to court. don't try and explain a confusing situation just take the plea bargain they will offer and be done with it.

wasting money on a lawyer would be stupid, it's not like an underage consumption will keep you from getting jobs.

a high school friend is now a CIA worker and he had 4 underages in high school/college on his record.

Around these parts, whether or not you were drunk or not is totally irrelevant. Passing the Breathalyzer means nothing.

If you are underage, drinking half a beer is still considered underage drinking. Whether or not you were intoxicated has nothing to do with it.

That happened to me once, but I had a strong case to fight it. He didn't breathalize me and I was on new medication that may have made me seem intoxicated. But the cop didn't show up a 2nd time after they pushed the date back.

Your going to have to play lawyer, be respectful and see if you can get out of it.
