Incriminating email?

A friend of mine sent a message to spores 101 saying that the jars inoculated with their syringes ended up with contams. they responded and mentioned that my friend should read over their policy on incriminating emails. i believe the growth of mycelium is legal in my friend's state of florida. either way, should my friend be worried?

Probably not, although your friend should delete said email asap. Your friend has more to worry about whom he tells in real life (hint-hint). :laugh:

Mycelia contains psilocybin (DEA sched: #7437) and psilocyn (DEA sched: #7438) which are both schedule-1. If you posess mycelia, you could probably be charged with manufacture of a sched-1 substance, posession of a sched-1 substance and perhaps add on "intent to distribute" onto that list as well. Within 1000 feet of a school district? Add "i'm really screwed" onto that list as well.

Spores 101 definitely does not suggest you do anything illegal with their LEGAL products, so why would they be complicit when you tell them that's what you're doing? I'd delete the emails, after all, the DEA doesn't appreciate artful fiction.

psilocybe mycelium is not legal in florida.

there was a court case in florida that said that a man could not be prosecuted for possessing fresh psilocybin mushrooms because it could not be proven that he knew they contained psilocybin.

any attempts to cultivate or process psilocybin mushrooms is definitely illegal in florida.

why would your friend email the company in the first place? if he had contams it was his own fault. people really need to be informed and know before they take upon such a hobby.

Why would the vendor turn you in, and announce to authorities that he has sold at least once to someone who used the spores for growing?

What they meant to say was, "Don't *fucking* talk about growing to a damn vendor!!!!!!" :smile:

I dont think your in any real danger but I would deleat the email and talk to us at the shroomery first.

The vendor is only trying to limit liability. Since spores 101 sells only psychedelic mushroom spores they could be held liable for aiding in the manufacture of illegal mushrooms if they give information about them in relation to manufacture. If I ran the company I would have to have the same policy. If you look at paul staments page he completely eliminates illegal mushrooms from his page due to the liability and negative image associated with illegal mushrooms. The website could reference you to a source of information that they were not responsible for creating and thus the liability would be transfered from them to the creator of the webpage. Even people stating they have no liability for a website could be held in contept of court, but the chances are increased from slim to highly probable if one actually runs a business.

That is just the way it works legally everyone. If you sell something to someone you are a business. I am not sure about eBay, you sell items but you don't have to apply for a business license. I am under the impression that technically this is illegal in most if not all states and counties. For instance if I sold a car to you and it blew up and killed your wife and children you have every right to sue myself, the car company, even eBay where the car was sold. Not like this is a everyday occurance but when a lady burns herself with coffee and is awarded 6 million in punitive damages our country really is a scary place todo business. Of course eBay as a army of top lawyers at its disposal to deal with issues and it has written an extensive agreement but these agreements don't really hold up in court anymore. Yet it is all in good faith to an extent. I find it insulting that some stupid idiot gets 6 million for spilling coffee on her legs. I would imagine the death sentence a more likely award for such a diseased and pathetic member of the USA. Natural selection is supposed to eliminate such weak DNA to be able to produce offspring.
