Cartoonist faces Greek jail for blasphemy
March 23, 2005
guardian.co.uk

He meant it as a piece of religious satire, a playful look at the life of Jesus. But Gerhard Haderer's depiction of Christ as a binge-drinking friend of Jimi Hendrix and naked surfer high on cannabis has caused a furore that could potentially land the cartoonist in jail.

Haderer did not even know that his book, The Life of Jesus, had been published in Greece until he received a summons to appear in court in Athens in January charged with blasphemy.

He was given a six-month suspended sentence in absentia, but if he loses his appeal next month his sentence could be increased to two years.

Haderer's book is the first to be banned in Greece for more than 20 years, and he is the first artist to fall prey of the European arrest warrant system since it was introduced in June 2002.

Yesterday in Vienna, a group of prominent writers and poets called a press conference to draw attention to the plight of Haderer, an Austrian, whose case they claim is crucial to the freedom of international artists.

"It is unbelievable that a person can write a book in his home country and be condemned and threatened with imprisonment by another," said Nikki Conrad, a human rights expert who organised yesterday's press conference. "But he is not going to just sit back and accept this injustice. He is prepared to take this to the European court of human rights. When Gerhard first got the summons he thought it was a joke. But now he is starting to get a bit nervous."

Mr Conrad added that a 1,000-signature petition of international artists, signed by people including the Nobel prize winner Elfriede Jelinek, would be delivered to the EU within the next two weeks.

"This campaign is crucial for the future freedom of international artists. Haderer is unique and situations like this will inhibit his artistic style," said the poet Gerhard Ruiss.

The Austrian comedian Hubert Kramar, who is next week due to star in a new satirical play about Christ, turned up to the press conference dressed as Jesus. "We are supposed to be living in a democratic society. Greece is in Europe and the whole idea of the European Union is that everything is supposed to be more open. But what happened to Haderer is scaring artists like me," he said.

Haderer's 40-page book has been already published in seven countries, including Germany, where 100,000 copies have been sold. Well known in Germany for his weekly illustrations in the news magazine Stern, he is to appeal against his six-month sentence in Athens on April 13.

I think it's pretty stupid that blasphemy is a crime anywhere, but that's not what makes this case so disturbing.

An Austrian broke a Greek law while living in Austria, and was sentenced to prison time.

I can't even begin to comprehend this...

Indeed, that part of the EU's charter or statutes seems that it without a doubt needs amending. It's equivalent to a man running a red light in the UK and being sent a ticket from US police, because it's a member of NATO. Absolutely absurd.

lol!

I agree with all of you, but what you must be aware of is, that recently,
the christianity and church in Greece lost alot of power and prestige, due to the fact of multiple apocalyptic scandals caused by priests (Billion $ savings, connections with criminals-helping their work etc.)

This made the whole church loose alot of power, and this case could be just an attempt to gain some of the respect-power back, by pointing out other things in order to make people pay less attention to them(trully ridiculous either way)

This has been the major subject in our news for like ,more than a month now..

For all you living in the land of freekdom, maybe i should remind you the case of Mike Diana,

In 1994, underground cartoonist Mike Diana was thrown in jail for 4 days without bail on obscenity charges, for publishing, advertising, and selling his zine BOILED ANGEL. Mike was on probation for 3 years, terms of which included fines of $3000, no contact with children under 18 (or within 10 feet of a minor), 1280 hours of community service, maintain full time employment, and at his expense, see a psychiatrist and take journalism courses at his own expense; AND no drawing for his own personal use... his home was subject to unannounced searches by local police to make sure he was complying. Mike Diana is now serving another 2 years of probation, including $2000 in fines, and the same probationary terms.

On June 4, 1996, a ruling issued by Largo, Florida, Circuit Judge Douglas Baird declared Mike Diana's zines, Boiled Angel #7 and #ATE as obscene. The judge emphasized throughout Mike's ruling that he personally found Diana's comics "patently offensive." Referring to Diana as "the appellant," and stated, "The evident goal of the appellant's publication is to portray shocking and graphic pictures of sexual conduct so it will be noticed. If the message is about victimization and that horrible things are happening in our society, as the appellant alleges, the appellant SHOULD HAVE created a vehicle to send his message that was not obscene."

Well, i'm shure i would prefer to live in Greece if i was a underground comix artist...

If this is illegal in Greece, then I have no issue... it is their country, they can do what they like. What bugs me is the artist was not in Greece when he created his artwork, nor was the artist a Greek citizen. I find it very scary that somebody living in one European country can be convicted in another for doing something that is completely legal in their own country.

Yes and when such countries have extradition treaties with one another like the USA does, such offenses could be a reason to extradite someone to Greece to stand trial.

Otherwise it would be like the mossad which goes into other countries and kidnapps people, like the Israeli who gave away Israels nuclear secrets... OR the Dawg, who is pretty much a dawn and his doq wife, whom with just her face could make me surrender.

Actually, this would never happen in the US.  Your grasp of US law and the protections for freedom of press are incorrect.

> but here in our union, sheeesh hell no.

So, the US system, which would never allow this to happen, in your opinion, is "buttfucked" and the EU system, in which this is happening right now, is somehow better?  Let me guess, European shit doesn't stink...

:whatever:

In many ways the U.S. has more freedoms than quite a few European countries, in terms of opinions, joining and starting religions and espousing ideologies.

Scientology is illegal in quite a few European countries, but in the U.S. you can join any cult you want.

Nazism is illegal in Germany, but in the U.S. you can espouse mostly any ideology you want as long as you don't threaten or harm another individual.

Europe is too socialist to have true freedom, the U.S., too conservative. In these ways, often Europe is better than the U.S. in terms of prisoners and drug laws, but the U.S. is better than Europe in terms of personal freedoms.
