From Time magazine, May 28 Canadian edition, in the Milestones section: ************************************************************ Convicted: Regina McKnight, 24, mother of three whose baby was stillborn in 1999 at 35 weeks; of homicide by child abuse for smoking crack cocaine during pregnancy; in Conway, South Carolina. In 1997 the State Supreme Court upheld the conviction of a mother charged with child abuse for using cocaine during pregnancy but McKnight's is the first homicide conviction. Expert witnesses differed about whether drug use caused the stillbirth, but the jury deliberated only 15 minutes before sentencing McKnight, two months pregnant, to 12 years in prison. ************************************************************ For once, I am speechless. pinky

i agree with bivalve.. 12 year IS a bit more then i'd give her if it was up to me, but i think it is certainly child abuse, and i don't really see what is so shocking.. ~Kriz

Yeah but how do you know the child would not have been stilborn anyway, despite her crack smoking tendancies.... This is completely a fucked up system. How abortions can be carried out and not called homicides is silly, in comparison to this case. Not that i agree with a pregnant woman smoking crack, thats just not a good idea, but crack is an addictive drug, give her a break.

I agree with chonger. This fucking system is fucked all to hell. You can chop up a baby in your womb and pull it out piece by piece, but just dont kill it with crack! Not to say that crack had to do anything with it, but its certainly a possibility. Just an example of the Supreme Court hard at work to represent the American People. They voted down the medical marijuana issue 8-0, yet 66% of people support medical marijuana. They upheld a ruling saying that you can be arrested for a minor traffic violation. Im so sick of fucking old fuckers ruling this fucking country. I hope that one justice gets arrested for driving while black. That will teach him to represent the american people. Probably not.

Well i'm fairly certain it is a proven fact that smoking crack while pregnant causes this to happen, and if she was known to have smoked crack its reasonable to assume that it was the cause. The odds of it being purely coincidental are slim to none, and not prosecuting because 'it might not really be the cause of it' would ensure everyone gets away with everything unless caught red handed.

Why? She still made the decision to smoke crack while pregnant. I know you smoke, but if you got pregnant (somehow defying the natural order of things), wouldn't you quit for atleast as long as you were pregnant. I know many girls who smoke before and after pregnancy, and they all stopped doing it for their child. Why should crack be any different? ~Kriz

What is so shocking is that she wasn't convicted of child abuse (never mind that an unborn fetus is not legally a CHILD in the first place), she was convicted of HOMICIDE. Not child abuse, not even manslaughter, HOMICIDE. To fit the legal definition of homicide, the state had to prove that she PLANNED to INTENTIONALLY kill a human being. Firstly, an unborn fetus is not LEGALLY defined as a human being. Whether it should be or not is irrelevant in this specific instance. Secondly, was she smoking crack as part of a PLAN to induce a miscarriage or because she was addicted? Without INTENT, there is no homicide, there is at worst manslaughter. Thirdly: since when has (intentionally or unintentionally) inducing a miscarriage (by WHATEVER means) been illegal? No, the only reason this woman was in court in the first place was because she did illegal drugs. If she had induced the miscarriage by eating a bunch of, say, ergotamine tartrate pills or by drinking two fifths of tequila a day for nine months, the charges would never have been brought in the first place. pinky

There was a law passed that states you can be charged with a homicide if you kill an unborn baby. This puts liberals in quite a bind. Do I support a good, "compassionate" law; or do I stick to my Liberal guns and disagree with this so my beloved abortion won't be threatened? Liberal hypocriscy is sick. I agree. This isn't a case of murder. It's a case of the government wanting to flex some muscle, and put drugs in a bad light (not hard to do with a drug like crack). The soccermom's will continue to support the W.O.D, because it looks like they're doing something about the drug problem.

The exact mechanism of cocaine-induced congential anomalies is presently uncertain, but it may be related to the placental vasoconstrction and fetal hypoxia produced by the drug, with the resulting intermittent vascular disruptions and ischemia in the embryyo and fetus causing congenital anomalies." "Cocaine easily crosses the placental barrier, and fetal concentrations equal or can actually exceed those in the mother. Direct organ toxicity can involve the hear, the CNS, and urinary system, and the GI tract."
