“Defelonization” is not a word you hear very often in the news business. Particularly when it’s in the same sentence as “schedule I drug possession.”

But these are strange and exciting times, and Colorado’s freshly elected Governor Jared Polis, is shaking things up in this state. On Tuesday of this week he signed a bill that will defelonize personal use possession of drugs like fentanyl, heroin, meth, cocaine, LSD and just about every other Schedule I and II substance. HB19-1263 instead makes possession of these substances a level 1 drug misdemeanor.

Which is to say, next time you’re caught with an eight-ball of coke, a gram of molly, a couple hits of acid or whatever other drug might be in your pocket, you won’t have to fear for your future. You’ll probably get a ticket and a talking to, you’ll probably have to go to court, pay a fine and maybe do some kind of community service or stint on probation. Your drugs will be confiscated.

But you won’t be hauled off to prison.

That’s a big deal. Non-violent incarceration for drug possession is indefensibly stupid and expensive. Not only are non-violent people being locked behind bars, to rot away in a violent place, surrounded by violent people, but it costs taxpayers a lot to maintain. If there’s anything the Drug War has proven, it’s that America’s drug problem cannot simply be “arrested away.”

HB19-1263 aims to address that fact. It will effectively protect non-violent offenders from having their potential squashed just because they got caught with a little blow in their pocket. Offenders will be directed towards treatment options instead of being thrown in a cell, which will save the state millions of dollars. According to a report from the Joint Budget Committee, this bill could save Colorado between $8.6 and $13.7 million just in its first five years.

It may seem like a small step in the fight to end the Drug War, but it really is a significant one. Colorado has a history of setting trends in this country, and now that Polis has defelonized personal use drug possession it’s not absurd to imagine that other states will follow suit. And if they do, it will deal a heavy blow to the criminalization of drugs and persecution of drug users our society is so hell bent on upholding.

That’s the only realistic way this country’s War on Drugs is ever going to be “won”: by softening the penalties for possession and redirecting government energy, resources and tax dollars towards treating the problem, instead of punishing it — by addressing the root cause instead of reacting to the side effects.

Polis’ “defelonization” bill will go into effect in 2020 (so, don’t throw caution to the wind just yet) and hopefully this is just the beginning. Hopefully this is just the start of a national drift away from this culture of mass-incarceration of punishing non-violent drug users to the fullest and most severe extent of the law.

Hopefully this is the first crack of many in the dam that’s keeping non-violent drug offenders locked up in prison.

Well i do have a lawyer but they got me with a guilty plea. Im on diversion right now so as long as i keep my nose clean the charges will be dismissed. 3 more months and ill be clear. Fingers crossed

You live in a common wealth state, only 5 remain and they have there own rules/laws that do not meet federal standards, like free speech, cursing in public place gets you cited and it does not require LEO to hear it, anyone can sign a paper saying you did it and you can be jailed!
The legal system in these states is so crooked its beyond any logic that was placed in bill of rights/constitution!
  The prosecutor and judge decide your case/outcome on a golf course or over lunch and YOUR lawyer is not even allowed to sit in, thats criminal in itself!
  They horse trade decisions, like I will pass these 6 DUI cases if you convict this guy with $10 of weed on him... Its so against our federal laws its sick.
  I have watched them take entire blocks of property owned by citizens under BS citations, like a untagged car on a driveway or grass to tall/dog feces on property and they take ownership of the property while you fight criminal charges over these citations!
  Then they sell the property off to developers in the area that couldn't convince you to sell it cheap enough for them!
  The entire area of (bayfront property) oceanview, Norfolk was taken by the city under the guise of expanding a road that was never going to happen, they took it for nothing and sold it off to developers to build expensive condo's and screwed the people who owned the property, some of these people lived there entire lives there and it was stolen from them!
  The trade off for being a common wealth state is states giving up some perks like federal assistance to disenfranchised citizens, so they get state help instead which may be subpar but it keeps the state doing its criminal activities w/o federal interference!
  The tickets for simply saying f*ck You to someone can be fought but the time/money it costs to get to federal court to overturn it is to costly, so people just take it up the *ss and accept the BS

Felony actually means treason.  What treason is to a republican conservative and what it means to a democrate are very different.  Anything that isn't sobriety or alcohol, raising kids to go fight profitable wars and going to church for some sort of community standardizing of thought is treason to conservatives.

Yeah youre probably right on that second point i mean raising kids to go fight any war should be treason to anyone but give me a fucking break dude. First off felony doesnt mean treason i mean its very easy to find the definition. Second, it doesnt mean different shit to different parties. If i had been caught in California with LSD the laws would be the same, considering the fact that theyre federal offenses.

Remember, lot's of Americans think Jesus is coming back.  Whackadoo people write laws.  Drugs to them make bad people.  I think it's a cultural expectation that is learned.  So legal drugs don't do that or mess people up? Those tend to be worse.  There's an assumption that drs know what they are doing and they do, their making a lot of money to drive audi's.

Going to church, and fighting wars, is treason to conservatives? Is that a typo? Because those are like their 2 favorite things.

I presume that's a grammatical error...at the start it sounded like you were bashing conservatives for their draconian views...but it ended very differently..

No, not doing those things is "treason" to their nutty ideology.

They think people should be serving their ideology.  They think because people used to do those things America was great without any thought of how their policies robbed people of any hope of liberty in a system like that.

They drew a line in the sand and starting ranting nonsense about america and religion, made all narcotic plants illegal yet still use propaganda enough to get dumb kids to fight their pointless and underachieving wars.

This is a more sensible and safe way of decriminalization. If you leave things too open ended with the phrasing of these legislations there becomes grey areas. People need to learn to differentiate people's drug induced behavior by substance, if you make only psilocybin legal the babies of society will blame that for everything that goes wrong in Colorado until public opinion is skewed. This way, it's up to toxicology to blame the substance when someone freaks out. Not a bunch of retarded Catholics. They actually are pretty good at propaganda.

The thing about being illegal, is people USUALLY respect the substances more...and value it more.

But illegal also brings a lot of messed up street education about substances.  Even thought street education tends to be more accurate about shrooms and cacti than even what drs say.  Most drs don't know much about these substances.

50 years ago these substances were not normal.  They are becoming more normal.  A lot of the nation is just abnormal when it comes to having intelligent conversations and voting results.

I'm afraid people are generally too stupid to have legal plants.  That was the fear of the Govt.  Although I do find normalizing society for what is normal very important.  Humans tended to be very egocentric and cultural-centrist.  They wholeheartedly thought the Universe revolved around them and that they were God's chosen people.

We know now since the space age that things are very bizarre and that's completely normal.  Natural drugs tend to be a hell of a lot safer and less potent than man made substances.  Lot's of folks fear that culture will get more bizarre and unstable.

I for one do not find nuclear weapons and chems in food a good thing.  1950s was bizarre in a lot of ways.  Pharmaceutical companies and drs will fight natural mind altering medicines.  It's not as easy as pin the diagnosis and med on the symptom.  Which is a really dumb way of understanding biological disease.  For Christ sake, they name a drug after what it's for.  Well, drugs do a lot of things and chemicals have no purpose other than what we use subjectivity to describe.

If they are both federal then its the same penalty however many of these crimes are state and the way its viewed/charged differs big time. Some states will take your shrooms and weigh them and charge accordingly, some will weigh the jars(spawn and all) and even count the weight of the jar its in to establish there charges.
Some states will charge you with posession of opium/synthetic opium and you may have actually harvested pure opium to weigh however you get the same charge for unprescribed methadone and its weight and charges based on weight even though 20% of the liquid or pill is actually an opium derivitive they do not separate the fact that its only part opium, they weigh it all, just like the 1980s when cocaine was shipped in hidden in coffee, they weighed the coffee with it when determining charges!
Some states will add years if your friend in the car with you is carrying a gun(even legally registered) if you commit a felony(posession of any drug) while in posession of a firearm(even though your friend legally owns/right to carry the weapon) YOU get the years because in the states eyes, you have access to that weapon or he will use it to protect you both.
Its sad because these same states arrest police for crimes like stealing drugs from evidence rooms and/or commiting felonies in other ways but the added time (posession of a firearm while in commission of a felony) NEVER gets added to the charge, when in reality they should be held to a higher standard due to being paid/employed by taxpayers and swearing to protect/serve... That very thin F*cking BLUE line they stand behind!

The US legal system is so F*cked its scary. To see people go to prison for murder because they "used" and obtained the drugs in which the person OD'd on is BS. They should never be allowed to be charged with murder because to murder someone requires intent to kill them! They just got high together! Same with the actual dealer, he gets a murder charge when the last thing he wants is a dead customer!
  To be in a car with a friend when the friend is driving, he commits a crime and during the police chase, even if its not a chase, the cop simply pulls you over to surrender, if a car runs that cop over or the cop crashes and dies in pursuit of your car, you the passenger and the driver are charged with MURDER OF  A POLICE OFFICER! when all your friend did was buy some weed in the wrong neighborhood!
