MORE THAN EIGHT YEARS after President Obama formally ended the CIA’s torture program, the Trump administration is fighting to block the CIA’s new deputy director from providing a deposition about her role in pioneering the agency’s most abusive torture techniques.

The Trump administration appointed Gina Haspel as deputy director of the CIA in February, attracting criticism from human rights advocates due to her former role in abusive interrogations. The move was interpreted as a public sign of the administration’s approval for some of the CIA’s most brutal abuses after the 9/11 attacks.

Haspel is being called to provide a deposition by James Mitchell and John “Bruce” Jessen — two contract psychologists who made tens of millions of dollars for their work shaping the CIA’s torture program. The ACLU is suing Mitchell and Jessen on behalf of three former CIA detainees — one of whom died in captivity in 2002 after being beaten and doused with cold water.

Lawyers for Mitchell and Jessen claim that everything the psychologists did was authorized by the CIA, and that Haspel would confirm that if the court ordered her to give a deposition. Lawyers are also seeking numerous documents, and a deposition from James Cotsana — a retired CIA official whom Mitchell and Jessen identified as their direct supervisor.

Haspel ran a secret prison in Thailand in 2002, part of the CIA’s global network of “black sites.” That prison — codenamed “DETENTION SITE GREEN” by Senate investigators — was the site of the CIA’s first prisoner interrogations after the 9/11 attacks, and Haspel supervised them. She later took part in covering up the abuses, helping to destroy 92 videotapes of interrogations against the Senate’s wishes.

The Senate torture report does not mention Haspel by name, but details the role of the prison’s station chief in the horrific torture of detainee Abu Zubaydah, who the CIA waterboarded until he became “completely unresponsive, with bubbles rising through his open, full mouth.”

Mitchell and Jessen were the ones who waterboarded Zubaydah, and described the interrogation as “a template for future interrogations of high-value captives” in a cable to the CIA. Zubaydah’s interrogation was held up as a model, and similar techniques were used on many of the 119 detainees the CIA had in its custody.

In a hearing before a district court in Washington state on Friday, the government said that deposing Haspel and Cotsana would reveal “state secrets,” and that despite media reports, the government could not confirm or deny Haspel and Cotsana’s role in the program.

Dror Ladin, a staff attorney for the ACLU, argued that there’s no need to depose Haspel and Cotsana because it would not affect Mitchell and Jessen’s responsibility for torture. “It’s never been a defense in a torture or a war crimes case to say ‘I was following instructions,’” said Ladin. “This case has never been about that. It was about the design of the program, its testing on Abu Zubaydah, the use of those techniques on our clients.”

For more than a decade, the Bush and Obama administrations have used the state secrets privilege to block numerous lawsuits against government agencies and the architects of the torture program. To this day no victim of CIA torture has ever obtained compensation for their treatment.

The lawsuit against Mitchell and Jessen is the first torture lawsuit the Department of Justice did not try to block in its entirety. Although the government is not a direct party to the case, it is paying Mitchell and Jessen’s legal fees. Knowing they could face legal liability for their actions, the CIA provided Mitchell and Jessen with a multi-million dollar indemnification contract in 2007 – meaning that if they were sued for their actions, taxpayers would foot the bill.

What do you guys think about this? Most educated people know that this does go on, the darker parts of being American. Ok with it? Not ok? Should it only be used on rare occasions?

the US doesn't torture people.  it does many/most things most other nations do, but somehow (likely the grace of a white Jesus) they don't count as torture

I don't see waterboarding as torture. The enemy does far worse to those they capture. If your talking about bamboo under the fingernails, or shock torture sure.. But the CIA and other entities should have available methods to gain information to keep Americans safe.

Fuck it, why not give a terrorist a cold beer and a gourmet meal. Who cares about the wanting to kill Americans and other people motivation.

In some cases, it won't work. But many do. We won't know the actual Intel regarding torture leading to good leads in terms of terrorism.

These are terrorists for the most part. Sometimes evil beyond comprehension. I've had the pleasure of being water boarded while in training around 8 years ago. It sucks, and it's fucking scary.

If these were average Joe's, no torture should be needed. But if it's an high ranking Al queda or ISIS high position,hell yes. We're not killing them, and the information gained can directly stop future attacks.

If you want the stats on this let me know and I will post them. But please don't give me the "were better than that" argument to torture. If you can stomach it, look up videos of isis creating demented ways to execute human beings. Whether it be drowning, burning alive, beheaded etc.. These people should be killed, but people are worried about torture..

Most of the time because the terrorists are using civilians as a human shield. We don't just target civilians, it's a lengthy process to determine the risk and reward of a strike. In war, shit happens.

While using legitimate interrogation techniques, certain applications of approaches  and  techniques  may  approach  the  line  between  permissible  actions  and  prohibited  actions.  It  may  often  be  difficult  to  determine  where permissible actions  end  and  prohibited actions  begin.  In  attempting  to determine if  a  contemplated  approach  or  technique  should  be  considered prohibited, and  therefore  should  not  be included  in  an  interrogation  plan, consider these two tests before submitting the plan for approval:

If  the  proposed  approach  technique  were  used  by the  enemy  against  one  of  your  fellow  soldiers,  would  you  believe  the  soldier  had  been  abused?
•
Could  your  conduct  in  carrying  out the proposed technique  violate  a law or regulation? Keep in mind that even if you personally would not consider  your  actions  to  constitute  abuse,  the  law  may  be  more  restrictive.

I want to be patriotic and say as an American torture is OK because it is helping us get the info we need to preserve our "great" country, but when it comes down to it we are no better than ISIS or any other terrorist organization, we are the same thing only we are politically, strategically, and societally organized. We are doing the same thing they are doing, but the United States is using the guise of "freedom" to liberate other countries which really means "steal their resources" and "strategic position" for future world conflicts. Arguably, that can be said what the proxy Syrian war is between the United States and Russia. And of course the other example would be South Korea. I mean that's what black sites really are...places where American law does not apply with regards to torture. So I'm assuming anything goes. Which is exactly why the government does not want any testimonies about it.

if the USA tortures, then torture of US soldiers is entirely justified in an eye-for-an-eye situation. You're the most powerful nation and military in the world, supposedly 'great' and supposedly represent some kind of 'ideals'. With a military the size of america's, I think you can afford to be the bigger man in situations like this. But apparently not :shrug:

If you torture some body long enough, they will tell you anything. They will tell you the sun revolves around the earth. It makes  no difference if or not waterboarding is torture. (except the people whomit happened to consider it torture) There is no reason to torture people except people enjoying sadism.

That's the craziest shit I have heard in a long time. How in any realm are we no different than ISIS? Yes the US bombs and kills suspected terrorists, and sometimes civilians get capped. (which usually is because the terrorists keep them near to prevent said strikes). But like Islam, and the Islam practiced by radicals, they have a completely different mindset that the US.

It's not always to gain resources as you said.we look out for the people getting oppressed. WMD's or not, we still kicked out an evil dictator. Same thing with the Syria airstrike, a message saying if you use chemical weapons, we will fuck you up.

ISIS want to create a caliphat, which I suggest you look up. They stone, burn, drown, shoot, behead and do ungodly things to people for petty "crimes".

It's just more circular responses and logic for if they actually made a point or conclusion there entire premise maybe exposed

Enlils true purpose is to get us off topic and to cast enough logical doubts so that outsiders viewing this would be more likely to side with his fake opinions rather than our or sometimes controlled opppsotions opinions.


You see if you are too skilled at not falling for their traps and stating logically sound debunks then other accounts who purposefully agree with 90% of the truth join in and get the entire topic off the main points.

It's their 1960s version of damage control and diversion but man it's painfully obvious in 2017
