What can you / should you do if you are violated with unreasonable search?

Hemp is the very useful low-THC version of cannabis and could be mistaken by a drug-sniffing dog as being pot. This confusion could lead to a violation of a citizen’s Fourth Amendment right “to be secure in their persons, houses, papers and effects, against unreasonable searches and seizures.” If an officer uses the wrong information from a dog to either search or seize a citizen’s property, this would be unreasonable.

Hemp is 100% legal. What does one do if this happens? Should you let it slide? What happens if non knowledgeable officer (or just a prick) finds it and takes you to jail and it's not even marijuana. Do they test the plant material on site to see if its marijuana so this wont happen?

Hey OP, you're in a legal state. Why do you care?

But it really depends if the police find anything illegal while they conduct their search. If only hemp is recovered, you won't be arrested and if something is found, that will be supporting evidence in the favor of the warrant. Either way a shitty situation.

I suppose if there was major damage to your property resulting from the search, you might be able to sue but the legal fees might not be worth the trouble.

Otherwise don't keep hemp near your drugs.

It's called probable cause, not must be cause. The cops don't have to be right for a search to be legal, they just have to probably be right.

That search would be legal (as long as they didn't make you wait for a search dog to show up. You can't legally be detained just so they can have the dogs sniff.)

Very interesting. I have family in FL and I shall be visiting sometime. I never like to drive with weed where its illegal (when I lived where it was illegal / FL, I always had it delivered to me when ever possible).

Hemp will be smoked on my way to FL and in FL until some hookups happen from old friends (I mean until they smoke me out at their places or I smoke them out, by paying for the bud).

I can't risk getting a record or legal troubles at this point in my life. It would cause so many problems.

The idea and subject just concerns me. Maybe ill just leave the hemp home, I can go a little while with just cigarettes...

Thank you for your info. It's important to know this stuff. If I do bring hemp with me ill also make sure to label the package to help ease confusion to any one that might happen to stumble upon it (more than likely relatives or non smoking friends).

Assuming you're already being searched.. Shut your mouth, admit nothing, ask for a lawyer. Seriously people start talking all the time because they think they've done no wrong only to end up fucking themselves. Give up information and shit the cops might not of even ever obtained to begin with.

If they're already searching, there is not really a damn thing you can do, any attempt to interfere at best gets you put in cuffs and probably held while they decide what charges, if any, to file. At worst, you catch a legit charge. This is why we have court and lawyers. Court is where you get to prove your innocence and have the bullshit thrown out.
