Whats the law on pictures?

I want to steal a picture of somebody to go on my website but don't want to get in trouble.

If the picture is not copyrighted can I legally use it?  Could I just take it and copyright it myself?

Would it make a difference if I edited the picture, say flipped it so the picture was altered slightly?

All photos are copyrighted by the photographer whether the photographer knows it or not.  Someone took the picture and it wasn't you.  If you use it I hope you get busted big time.  Here at the Shroomery all photos downloaded to the site are under creative commons, like the link says at the bottom of the page.  If you don't want someone "using" your pictures, don't post them here.
