"My fictional(SWIM) friend" had court yesterday. USA Federal mushroom case.
    #28552393 -

Figured this might be the most relevant forum to post this fictional(SWIM) story in. I might post this in another forum without being anonymous, but not sure how best to present this story.

In the summer, my friend was at his buddies when a raid took place. DEA came in and found what appeared to possibly be a relatively large(subjective) mushroom grow. Turns out they had gotten some sort of tip off and have been watching the place and the people involved for some time. No one was arrested at the time, everything was confiscated. They were looking for something else, warrant had different substances listed.

Four months later, two days ago, the DEA arrested some people related to this. Yesterday, was the first appearance in court, having the federal charges presented.

Federal mandatory minimums may not be enforced, because of the way the indictment is worded, it's up to the judge's discretion. If they were enforced, everyone is likely required to do 5+ years MINIMUM. For anyone who is not aware, in the federal court system in the USA the judge has a lot of discretion on what to choose as the punishment for the charges, except there are currently federal mandatory minimum charges for drug cases, dependent on the quantity found. If in the indictment the quantity of controlled substances found is listed, there is a chart  dictating what the minimum time is for that quantity.

My friend is learning how much, in the federal system, it is almost entirely up to which judge you get, what your punishment will be for your charges, if you are found or plea guilty.

Stay safe people and be fully aware of what the REAL risks can be. Yes, the government doesn't care that much about mushrooms and it's easy to think you'll never get in trouble, but if you end up in a situation where you do get tied up with federal charges, the stakes are high.

The stakes can theoretically be high at any level. I do believe the overall risk is low, due to both lack of interest and the likelihood that judges won't be particularly motivated to throw the book at people for them. But nobody else can determine the level of risk that YOU PERSONALLY face. I definitely stick my neck out in ways that only feel comfortable to me because of where and how I live. If I rubbed elbows with sketchier people, or lived in a more predatory and ass-backwards legal environment, it would be a completely different story.

I hate to say it, but I think the key here is that they were looking for other substances when they conducted the raid. That speaks to either being involved in sketchier activities, living in a place where police are bored and shitty, or both. The DEA doesn't just randomly turn up to raid peoples' houses. Money was spent on investigations.

I hope it all works out alright for you and your friends.

I think everyone who wants to should just grow, until the system is overwhelmed and they have to just give up (I honestly believe that's part of what has fueled cannabis legalization). But you're definitely still taking on a real risk when you do.

Let's think what was the real reason to raid and where mistakes have been made. They can't just randomly come up with the raid. It has some reasons. Let's think which reasons?

The guess is that, one of the other people involved was also involved in other controlled substances, including the named concentrated cannabis products. He has had some falling out with some previous business partners in the past couple years. One of these previous business partners has gotten in legal trouble in the last year or so, it's very likely he did a proffer and offered evidence about this situation in the hope of having his sentence reduced for cooperating with the government.

That is normally how these things go, many many people will rat out others to try to save themself.

There were many mistakes made here and way way more risk taken on than ever should have been. Everyone was careless and made stupid choices.

Update on court case:

Sentencing is coming up next month(august) most likely.

Prosecutor is recommending 2 years and 7 months for SWIM. 4-5 years for their codefendants that were more involved.

Edit: After reading through the previous messages, wanted to add more context for what to be cautious for.

The DEA had been surveilling a couple of the people involved in this for over 2 years. There was an informant involved that was occasionally coming by the property as well and collecting information.

Two primary reasons it seems the DEA cared:

1. The house for the grow was used previously for cannabis grows and was popped before. They are upset the owner wasn't learning his lesson from previous raids and state cases. that is likely why this legal case stayed federal instead of getting dropped to state. The government is confiscating the property.

2. One of the other codefendants was involved in other substances and had a lot of lab equipment. They saw in his trash evidence of various solvents and hazardous materials that were being used for DMT synthesis. And they also had a tip off that he was involved in synthesis of GHB, which to my knowledge is not true, but I don't know for certain.

The attorneys are surprised this case is happening, the few that have been spoken to or are involved in the case, say this is the first federal mushroom case they have seen and they believe if the government just thought there was mushrooms going on, and there wasn't this guy with a bunch of priors who was in complete disregard for the previous busts or a potential ghb lab, they likely wouldn't have pursued this.

If you provoke them they will destroy you.

These guys had a long history and what's the point of making a date rape drug?

It also appears they didn't make any efforts at discretion, had narcs around.

If you refuse to take them seriously and fuk them off, they are unlimited in their ability to squash, squeeze, come by and smash up again.

My friend pissed them off and they hurt her badly for a statement

Rabbi Ariel Pedersen and NY Pharmacologist

And when the court didn't hurt her bad enough to suit them they came back and smash her up again

Do not provoke these people or think you're going to fuck them off and laugh about it

Another update:

The codefendant that had the lab is doing 8 months in custody and is already surrendered into custody. he got a much lower sentencing because he cooperated with the government, at least offering to testify against his codefendants, likely cooperated more by telling them about any leads he may have for other people to go after.

SWIM was sentenced this past monday to 20 months in custody. Likely will actually serve closer to a year, maybe a bit more or less.

The Main person they are after will be sentenced early December and will likely be sentenced to closer to 3-4 years.

That sucks dude.

Be aware of your surroundings, but try to relax and let the time pass by on auto like it does whether you’re inside or out.

The rule #1. Tell no one that you're growing and consuming shrooms.
