Yeah so I was in New Jersey over the weekend. Got kicked out of a bar for taking a bottle from behind the bar. Really stupid I know. The cops were already waiting outside the bar, so they told them what I had done. I got arrested. Happened to have a little less than an eigth of mushrooms in my pocket. Went to jail and then the prison until my friend bailed me out. So I was charged with theft and possession. I dont have any priors except an open container a couple years ago. Before you tell me what a stupid fuck I am, I already know. This is the end of alcohol for me. Went to my first aa meeting (pretty weird but thats another story) bad things happen way to much when I drink so I have to stop for my own good and for people who rely on me.
Interesting side note: the cops were fascinated with the mushrooms. Didnt even know what they were when they saw them, asking me how much that amount would cost, where someone would even find these etc, and the charge actually says possession of magic mushrooms which I think is kind of funny and evidence of a lack of knowledge.
Anyway.. Has anyone gone through this. I am really scared. Any advice or experiences would be appriciated. Criticism is fine too

Sounds like you just gotta face the music and take your punishment. At least you've quit drinking which sounds like it was fucking up your life. In the future, dont carry drugs on your person, esp when out getting drunk. Leave your drugs at the house. Just move forward and stay positive, put this behind you.

There is that ask attorney thread,guy is enlil in safety and security ,I don't know the penalties for nj,if u don't have a record for drugs most likely it will be probation for such a small amount,the bottle thing,most likely misdeamenor petty theft ,if u didn't actaully leave with the bottle they might say willful concealment,maybe ask around for a decent attorney if u have the cash or just go with a public d and be on their case about your case,gotta really show them u care or a lot of them will just do the bare minimum.

If I were you I would do everything in my power to get those charges dropped. Any type of conviction will follow you the rest of your life.
Deny everything, demand a jury trial, plead guilty to a disorderly conduct charge at the most.
Be careful hiring an attorney, many are not worth their weight in horse manure. If you can get a personal reference for a good trial attorney go with that. The best trial attorneys can always get the best plea deals.

I guess yous two don't Reed good bcuz he said he was drunk and tried to grab a bottle behind the bar. Does this sound like someone who remembers the drugs that are already in their pocket?
Also op never said he knew the pigs were there, he said they were already there, but claimed no knowledge beforehand.
Op also said he knew what he did was stupid. He wasn't asking for ways he could have avoided his situation, any idiot can sit and point out things he couhave done. I got one, how about if op stayed home and didn't go out that evening? What if he left his shrooms at home? Ok ok, here is a good one, how about if we tell op he shouldn't have grabbed the bottle from behind the bar! Wow we sure are good. Maybe the three of us should open a counseling service, we can nitpick other's actions that they have acknowledged were wrong and then feel like we are smarter than we are!

^^thanks. Yea i wish i knew they were there or I would have. I assumed I was just being kicked out. Thanks for the helpful advice I appricate it. I can't really afford an attorney and all my quick money making options have been thrown away, so I will be going the p d route. I realize how fucked I am if I get a felony because of this, so hopefully I can get through it with a misdemeanor and fines community service etc.

Do not, repeat: DO NOT tell on yourself. Often busy court (also in not so busy) rooms the police and prosecutor will count on the defendant owning up to his wrongdoing with a guilty plea.
Unless you have filled out a statement claiming what those shrooms were and also claiming ownership of them and even if you did it's time to deny everything.
If you have no criminal record it could be a lot easier to win a jury trial than you might think. Deny any knowledge of any wrongdoing. You were not taking a bottle you were saving it from falling off of the shelf. You had no idea what those were in your pocket, you picked those up off of the bar floor because it looked like trash and you just wanted to help out.
Excuses don't have to be good to be believable, the key is to sound sympathetic with their argument, your too nice to flat out say they are wrong or lieing, they just made a simple mistake. Also the bar that sold you all that booze and then pushed you into the arms of the police after shoving a bag of drugs in your pocket could be the true villain in this scenario.
Not all public defenders suck ass as lawyers, just the vast majority, you could get lucky and get a good one, but don't count on it. If you insist on a jury trial you will most certainly get a better deal than if you walk in and plead guilty. If your public defender makes any threats of a stiff sentence for demanding a jury trial get him/her on recording and ask for them to put that in writing.
Stay strong and don't let them break you. Good luck brother.

Shit man now is not the time to loose your pair. You were drunk, maybe you thought the bottle was falling, maybe you thought there was an earthquake, doesn't matter how ridiculous your story is, so long as it plays with theirs and you sell that shit like you believe it. Does it matter if you look like the stupidest kid on the planet if it gets you out of this?
At this point of the game the actual facts are not helping you. Plausible deniability, a term usually reserved for the wealthy, is your best friend right now. You were drunk. This is the only fact that could benefit you. Drunk and disorderly, that is what you plead to, anything else you want a jury trial.
Mushrooms are not illegal ,the compounds in any given mushroom could be illegal if it is a scheduled substance. They certainly don't want to pay to have the lab run up test on a tiny bag of shrooms. If you demand jury trial then they will be required to submit the drugs for laboratory analysis, most crime labs have backlogs and testing a couple grams of shrooms isn't going to be on anyone's priority list, unless they swipe them to test out what the dose feels like. This happens more often than you think and people get great plea deals all the time because the pigs lost their evidence .
Despite what anyone may tell you, at this point you can only improve your situation by demanding a jury trial. It's a whole lot of stress, but trust me a years worth of stress will do you better than a lifelong record. You know your going to plead out, but don't let your public defender know.
The more convinced your public defender is that your serious about demanding a jury trial the better your deal gets. Often times public defenders are hoping to get invited to a barbecue at the prosecutors house, they are often young and inexperienced and are trying to make friends with all the other lawyers in town. You convince them your stupid enough to go to jury trial ( only jury trial! Under no circumstances accept a judge or a magistrate trial) and you will get your drunk and disorderly plea.
It's your life and ultimately your decision, I have offered what I think your best path to conclusion should be, the best of luck whatever you decide.

Anon 5 I wish I could inbox you to say thank you. That advice is really helpful and puts things in perspective. Being drunk could be the most helpful thing lets say I was blackout drunk, I don't even know how the shrooms got in my possession. Ive never even tried mushrooms before. I was never brethalized or tested in any way so they cant really prove how drunk i was or wasnt. Although I did provide all kinds of detailed info and conversed with the police in a perfectly coherent rational way. Still though all they know is that I had been drinking and have no proof one way or the other of how drunk I was (unless they do? Do they record what happens and what was said in the station it would be ironic if speaking coherently and politely with the police hurt me in the end)
When they asked me where i got them from all i said was some hippy man

Ive been doing a little research. Because the stolen property is less than $200 it counts as a disorderly persons thing, so thats good news. However psilosibin is schedule I (so ridiculous) carrys a fine up to 35000.

Anon 5 is giving you terrible advice. You will not win this in a jury trial. Denying based on being drunk, with witnesses to testify against you, is a sure win for the courts. Get a good attorney, and he/she will get you treatment to get the felony dropped. You do not want to take this to trial.

#5, your advice is excellent. We have all, or most, been conditioned to simply fall into line and confess to authority, rather you are providing information on how the system can be played by those who are in the positions of power. Plausible deniability, the worst criminals in the world get away with atrocities around the world, mining is a good example, and get away with it. There are excellent examples, you can search for it, of a documentary on a Vancouver based mining company working with a the Eritrean leader who is accused of many human rights abuses. Some interviews with the company spokesperson would be good for #1 to check out, his way of denying may help with strategizing. The support a dictator and make millions and get away with it, you can get through a bottle and a bag of shrooms.
