you dont get charged for smoking marijuana, you get charged for possession. if your on your front porch, smoking a joint and thats all you have, n all you get charged with, i guarantee you will not be sentenced to do time in prison. MAYBE a few days in jail, but not a state prison. i dont care how backwards n retarded your state is. hell, you ALMOST have to commit a felony to go to prison, but there are a few people locked up for misdemeanors, usually only 6 months or less.

You only get prison for weed possession if you murder the entire police officer's entire family in front of him.  Do not do it.

Possession is often a felony, and if you sell or grow you can most certainly go to prison.  If you are on parole/probation and you get caught with possession you can go to prison. 

People can, and do, go to prison for weed, other drugs and completely nonviolent crimes.

just because ppl may not go down and do real time for weed where you live does not make your experience or your town, county, or state the norm.

if you haven't been to the deep South, you haven't a clue and should stop making blanket statements where you are as knowledgable as a preacher in a whorehouse.

True on most counts, but most possession in most states is a misdemeanor. Only first degree possession is a felony in my state and you have to have over an ounce in one bag. If it's in multiple bags you will most likely get poss. with intent to distribute. Now THAT'S a felony.

In Ohio and a few other states, you can have up to a quarter pound in one bag and it's still only a ticket.

YES, THE DEEP SOUTH, WHERE wait no it's a misdemeanor for up to 1oz in Tennessee.  I lived in the deep south, stop creating imaginary boogeymen to hold up your argument.  I know plenty of people down there who got busted and just had a few month's probation -- and all of the busts were incidental, accidental affairs.  The cops didn't care that they were smoking pot, they just aren't able to safely look the other way all the time -- though they do frequently enough anyway.

that, sir, is not a misdemeanor in Texas; Tennessee if i remember correctly is one of those states, like california, where the main cash crop of the whole state is bud, if the comptroller's report were honest.

Tennessee isn't Alabama, or Georgia, or Louisiana, or Florida, nor even Texas...try getting busted with two bags of bud even if you ARE only getting it weighed for you and your roomie cuz your scales are broken.

if you get a misdemeanor, i'll put your lawyer on retainer on the spot.

don't go spreading stories that make it sound like a minor in possession of alcohol charge or a traffic ticket...it IS that way in Cali and some other places, but NOT here.

maybe in tennessee you would get a 25 buck non moving violation, a ticket you didn't have to appear in court for that wouldn't go on your permanent record, and get to keep your sack - that is just what happened to me in Cali.

don't expect it in texas.

I LIVE in the deep south, and know the laws VERY well (Its important to educate oneself on relevant issues).

I have marijuana convictions, and I know people who had serious felonies. Only ONE of them went to prison, and it was like the OP said, for a short time of 6 months or so.

It IS unlikely to go to prison for drug violations, unless they are extremely serious violations.

What I meant was, no one goes to prison for smoking pot. If you go to prison related to drugs, it wasn't for just smoking a joint guys.

you clearly won't believe someone just because they live someplace and have intimate knowledge of the system there, preferring to believe that the customs of your tribe are the way the whole world is. the fact that one of my martial arts teachers is a DPS trooper and DPS chemist, while my other teacher's dad is a DA and has been my lawyer on pot charges in the past is of course irrelevant in the light of your prodigious intellect and wide-ranging legal experience in all 50 states.:rolleyes:

so come do some research for yourself. prisons are a growth industry in Texas.

idiot. my black belt teachers have jobs besides teaching clumsy oafs like me martial arts. real lives you know? since they know i smoke bud and don't hassle me about it, i don't hassle them right back.

since the DA got in on saying that the cops must have better things to do than bust high school kids with grams of pot, and chased the asshole republican that was there out - on top of popping me from rehab 6 months early and making my probation officer eat it and live with it; i'd confidently say he was on our side.

ok.

two different bags is intent to distribute. thus, the felony. i dont care how far in the deep south you live, or the shallow? north, simple possession is a misdemeanor, because-wait for it- there isnt room in prison for simple, petty bullshit crimes. the only way you go for pot is possession of a felony amount, intent to distribute, or cultivation of a schedule 1 drug, which are all felonies. not simple possession, because it is a misdemeanor. not to say you wont go to your county jail for a few weeks/months, but jail and prison are two waaay different places, for waay different crimes.

i dont care what state you live in, if they receive any federal funding for their prison system, and only one state doesnt (does anybody know what state that is?), then those states have to follow federal sentencing guidelines.

tennessee is a bit lax, yep.  i know folk who got busted in alabama, too.  lessee, the one bust was incidental -- the cops were there because someone had put their address down when they got a traffic ticket, and then never paid it, and they showed up for him while there was a lit joint.  28 pieces of paraphernalia, 2 scales, and about 2g of pot.  result?  1 year probation, 60 hours community service, and it was all taken care of after 3 months and ONE SINGLE HOUR of community service.
hmm, another incident was incidental in the course of a DUI arrest.  Happened again to the same person about a year later..  and then again, and it all went away thanks to enlisting in the navy.  i myself was pulled over a few times in that state, reeking of pot, at odd hours of the day and night, but thankfully the cop at the window was never asking for my license..  I just ran into a few fugitive searches, traffic accidents I needed directed around, basically the sort of shit that the cops are stopping you just to help either you or them but not to bust ya.  not one ever said a word or wanted to search my car.  because smoking pot is not a big deal to the vast majority of cops (at least locals) in the state of alabamy.
kentucky?  hell, kentucky is the 3rd largest producer of marijuana in the US.  YEAH, BLUEGRASS STATE!  You thought that was for lawns.  Naw, it's for lungs.  It's not a big deal.

Seriously, the South?  Doesn't have a problem with pot.  *Texas* has a problem with pot.  Top pot producers in the US are mostly southern states.  Actually, it's southern states + california and washington.

texas just throws a hissy fit over pot because it's too fucking hot and dry to grow anything other than ditch weed down there, snarf snarf.



ps google says nebraska didnt apply for federal funding for the prison system?  thats probably because corn doesnt take a lot of money to incarcerate
