Saginaw man found guilty of felony murder in fake crack cocaine case

A 21-year-old Saginaw man will spend the rest of his life in prison for murdering a man who refused to pay him for fake crack cocaine.

A jury of eight women and four men convicted Robert D. Rucker of first-degree felony murder in the March 24, 2008, shooting death of Stanley M. Kelsey.

The jury also found Rucker guilty of possessing a firearm while committing a felony and two counts of distributing or manufacturing an imitation controlled substance.

Prosecutors charged Rucker with first-degree premeditated murder or, in the alternative, felony murder -- the act of intentionally killing someone within the course of committing a felony. Both carried sentences of life in prison without the possibility of parole.

Saginaw County Circuit Court Judge Darnell Jackson will sentence Rucker, who last lived at 3012 S. Washington. Court officials had not yet set a date for sentencing.

Kelsey's friend, Victor Stewart, testified last week that Kelsey wanted to buy $15 worth of crack from Rucker but that when Kelsey tasted the crack rock that Rucker gave him, he said it was fake and refused to pay.

Rucker, 19 at the time, and Kelsey, 36, began to argue at Gilmore near Bundy on the city's East Side about the money, witnesses said. Rucker demanded Kelsey give him the money and then shot him, they said.

Rucker's attorney, Phillip R. Sturtz of Saginaw, said during closing arguments that the shooting was accidental after a shoving match between Rucker, Kelsey, and Stewart.
