It's illegal to import spores from another state. It's not illegal to own them.

It is illeagal to own spores, UNLESS you are a researcher and have the proper paperwork and permission from the DEA.

No, it doesn't say that.

Section 11390 says you can't cultivate psilocybin containing mycelium.  No surprise there.

Section 11391 says you can't give them away, sell them, import them into the state, etc.  Note that this only applies if you intend to cultivate a controlled substance.  It does not apply if you want to view the spores under a microscope or clean your toilet with them or have a spore ball fight.

Section 11392 says you can get a license to bypass the other sections if you have the appropriate permissions.

Nowhere does it say that you are not allowed to possess the spores of psilocybin mushrooms.

As far as I know, no one has ever been charged under any of these sections.

However there are other laws that are applicable, and I would be much more concerned about those.  Specifically, attempted manufacture of a controlled substance is a felony charge that could be applied to anyone who is found with psilocybin spores and cultivation equipment.  Fortunately the law is very rarely applied in this way, and its unlikely to be applied if you shut up and don't talk to the police.  If you admit to the cops that you were thinking about growing cubes but then decided not to, you just talked yourself into a felony conviction.  Speaking with the police is also very likely to get you charged with conspiracy to manufacture a controlled substance, so don't do that.

Most overseas vendors don't care about the stupid misdemeanor california law, so its possible to order them in CA that way.  Most people just get them shipped to another state and remailed by a friend, which is a safe thing to do as long as your friend is very quiet.  There are also many psilocybin containing mushrooms that are native to California - See http://www.shroomery.org/8461/Which-psilocybin-mushrooms-grow-wild-in-my-area

The technicalities in the law are pretty irrelevant; the main point here is that yes, you can order spores from CA, don't you worry.

Here are the condensed facts straight from the CACC:
1) It's illegal to import,export,buy,sell, or otherwise exchange (active) spores in the state of CA.
2) It is illegal to (or intend to) grow mycelium or mushrooms containing psylocybin or psilocin, or to have any form of this substance in possession.

Basically the trick here is if you FIND an active mushroom, take a spore print and keep it. You are safe.
-You may not keep the fruit body as it contains active chemicals.
Make note that the law specifically states that you may not import, export, sell, (etc.) them for any reason, not even research.
