Pot seller out of jail for review of case

Skowhegan , Maine? An Athens man who is appealing a sentence for drug trafficking on grounds that he cannot survive prison food is free on bail pending a Maine Supreme Judicial Court review of his case.

Herbert "Ted" Hampe, 39, was released from the Maine Correctional Center earlier this month after a relative posted $5,000 cash bail, according to records in Somerset County Superior Court.

In late September, Hampe was sentenced to four years in prison, with all but 18 months suspended, for trafficking in marijuana.

He was sent to Maine Correctional Center on Sept. 30 after failing to come up with post-conviction bail. He served 10 days behind bars at the Windham facility before bail was posted and he was freed.

Hampe had argued that his rights were violated during his trial, but also that he shouldn't be sent to prison because prison food contains too much salt.

Sodium reacts with lead left in his body from a 1984 police shooting and causes him to get sick, he said.

"My life depends on staying free, due to my special diet of no salt or oxydizers," he wrote in court documents.

Hampe was convicted of trafficking in marijuana in July, four years after Somerset County deputies found more than 300 marijuana plants growing near his home off State Route 150.

After his sentencing Hampe appealed both the conviction and sentence.

Hampe could not be reached for comment Friday, he did not return a message left on his answering machine.

First Assistant District Attorney Evert N. Fowle said that Hampe is free now, but predicted he will eventually serve his sentence.

"There are no grounds for appeal and it sure would be nice if Mr. Hampe accepted responsibility for what he's done, served his sentence and got on with his life," Fowle said.

"He's only postponing the inevitable, and if he violates the law in the future the bail posted in his behalf will be at risk."

Its dad to see anyone go down on drug charges, but how stupid can you be? Growing 300 plants next to your house is just asking for trouble.
