the most you can do on a bank error is sit on it for who knows prob 7 yrs
otherwise you can look at it as a mistake and logistically spend it or invest it knowing that IT WILL COME BACK TO HAUNT YOU if you dint pay it back or claim ignorance and pay it back in low installments
if i was dead broke and this happened to me id take it out if i needed it and then claim ignorance and pay it back but as we know they're making their mistakes criminal on our ends if we take advantage of that situation

and to make another point. the teller at the bank that made that mistake could possibly lose her job if they find out what happened. what if he/she has kids? what if he/she's already in a financial bind? can you do the right thing or will you be a selfish prick and stoop to the people's level you are laughing at in the title of your post?

found this "faq" on helpwithmybank.gov. regarding banking errors.
Quote:
A deposit was credited to my account by mistake. Does the bank have to get my permission before removing the funds?
No. If the funds are credited to your account in error, the bank doesn't need your permission to remove funds. The bank may correct the error by exercising its legal right of off-set. This right allows a national bank to charge your account for a debt owed to the bank.
To correct this error, the bank must remove the funds from your account and deposit them into the correct account.

You seem to of misunderstood slightly.
There was no teller. Theres no electronic error.
I sent a letter complaining about overdraught fees. I received a letter stating they are giving me a "gesture of goodwill" "which represents 50% of charges incurred over the last 2 years" it also says this resulted from them studying my account in response to my letter.
The error must lie with the person that has studied the account or with me - if I was to conclude that I actually have been charged that many fees and not realized. I don't think I have though, considering the account is hardly used.

Well like, it's not like they'll be scrutinizing all their paperwork. I mean, somewhere in there is a number, which divided gives 773$, and has been paid out as a form of goodwill. And like, that number is still probably sitting right next to yours so it will look legit. It's all incorporated in their totals anyways, so it won't look like anything is missing. Unless someone is working there checking bank accounts randomly to see if they add up you should be fine right? And if goodwill payouts are to be approved, I'm sure that the higher-ups have already seen, signed and green lighted the payment.

You seem to have misunderstood. The credit you received was a transfer of funds from the Banks funds to your account. The charges being reimbursed was issued for 50% of of the charges incurred over the last 2 years. The total for the charges was 60$. 50% of 60$ is 30$.
There is no such thing as a bank error in your favor. That only exists in Monopoly. Call your bank. See if they agree to give you the money.
When they do their hard audit, they will ask where the money is. They will notice that you got the 30$ you are entitled to for the dispute. They will also see that you are generously holding $743 of shareholder money. When they want their money back, you will give it back. Its not your $743.

The bank has every right to take back the money.
I'd leave it in the account for at least a year.

If that was the case then he wouldn't have gotten any money in the first place. This isn't kindergarten, you won't get sued for indian giving.

This is electronic. There is paperwork attached to the electronic transfers. Unless he uses a bank which only does paperwork. Do those even exist? Probably in African tribes.
Electronic Funds Transfer is a system of transferring money from one bank account directly to another without any paper money changing hands.
If they sent you a wad of cash in an envelope, go ahead take it. If you had money deposited into your account via electronic trasfer, it will fall under the EFT Act.The paperwork said both 50% of 60$ and $773. Its not a game of picking and choosing which one he would like. Its what was supposed to happen.
Getting money for nothing is an awesome idea, but you guys are clouding your brain with fantasy. Look at it for what it is, not what you want it to be.

Take a chill pill brain.
I have not misunderstood at all. I'm quite aware of the maths but the point is I don't give a shit.
I'm keeping this money because I'm not stupid. What do you want me to do?
I don't understand why your ranting, when I said about "misunderstood" the post wasn't even directed at you.
The banks given me the money, I have ample excuse to claim ignorance and I'm fucking keeping it. If they want it back they can take me to court. I don't mind - if a judge tells me to pay it back, I will.

That $713 will cost you much much more if they ever realize that it's gone and you spent it.

That the most stupid thing I've ever heard. You guys are clearly jealous and trying to put me down.
The money is a "goodwill gesture" for all I know completely legitimate despite me suspecting differently. I have a letter to prove it. No court will make me pay more than the amount back as its not my error and the bank have told me its a "gesture".
There is gonna be no "learn the hardway".
Are you really that stupid and scared that you'd just hand the money back if it were you? I doubt it... Your just trying to put a downer on me because I've had some good luck.
