Exactly. The fact that he was BORN American should not, in my opinion, make any difference at all... he was not a member of the US military. He should be treated no more harshly than any other Taliban member. Any fair verdict must be based on what he DID, not on who he IS.

Their are some things I just dont get here...

#1, if you knowingly join a foreign military force you are no longer concitered a US citizen for the rest of your life. This is even printed on passports but in diferent words.

#2 The US was one of the only nations to conciter the Taliban as a leading government power in Afghanistan and their Military is what John L. Joined.

#3 How can the US decide that he is still an American when it is clearly written in law that once he became part of the Taliban fighting force that he was no longer a US citizen?

20 Years in a US prision? I dont see why we should waste our money on him, feeding him and keeping him warm at night. Lets treat him like all the rest...

Good post. One small thing, though... you say:

The US may have unofficially dealt with the Taliban as the de facto ruling junta in Afghanistan, but they never officially recognized it as such. There were only two nations on earth who officially (meaning accorded it full diplomatic status as per international law) recognized the Taliban as a legitimate government -- Pakistan and Saudi Arabia.

However, this does not detract from your argument at all, in my opinion.

all of this talk about how his punishment is in conflict with accepted law, get used to it. In case you haven't noticed the government has been pissing on itself for decades now; even the constitution doesn't seem to mean a damn thing anymore, nor has it in the recent past. Our government will continue to do whatever it believes to be in its own best interest, no the best interest of its citizens. This outrageous sentance is the beginning of what Orwell had predicted, the organized process of attmpting to use the anger and hatred of people to prevent them from being concerned with the real issues at hand. Luckily, we'll never fall for that because we have the mushrooms on our side.

they sentenced a woman for 5 MORE years than he recieved for an accidental fire. WTF? accidental fire wasn't damn near as bad as treason

I was thinking the same thing. Also, if he had been stripped of his citizenship under that law, would not we also have to legally call all of the Taliban(not al q'eda) POWs by extension?
