Men guilty over fake penis scam


Tests rely on testing urine samples to check for drugs

The makers of a prosthetic penis to help men cheat on drugs
tests have pleaded guilty to two charges of conspiracy in a US federal court.

The two men, George Wills and Robert Catalano, had been selling the device
- known as the Whizzinator - over the internet for three years.

The device was sold with a heating element and fake urine to help people
test negative for illegal substances.

They could face up to eight years in prison and a $500,000 (£334,000) fine.

The men ran an internet company known as Puck Technology, which between
2005 and 2008 sold the Whizzinator and a similar device, known as Number
One.

"The Whizzinator is the ultimate solution for a drug testing device," says
a statement on the website of the California-based company, which calls
itself the "undisputed leader in synthetic urine."

"The prosthetic penis is very realistic and concealing is simple, while
our quality production and materials assures you that the Whizzinator will
let it flow again and again, anytime, anywhere you need it!"

Mr Wills and Mr Catalano appeared before a federal court in Pittsburgh,
and are scheduled to be sentenced in February.

As part of the investigation, there were two undercover purchases of
the products on Sept. 8, 2006, and Feb. 7, 2007.

Mr. Catalano and Mr. Wills pleaded guilty to conspiracy to sell drug
paraphernalia and conspiracy to defraud the United States government.

Puck Technology also pleaded guilty to the same charges. The company
has stopped operating.

wouldn't it be better if they were wearing bio-suits and super-hero capes made from red/white/blue French national flags while weilding plastic penises and carrying little growling chihuahuas in purses slung over their shoulders?

They plead guilty.Its their own fault if they go to prison because I'm sure they could have got at least a hung jury..
Why Its against the law is beyond me..Maybe they should have put on the package "for Novelty use only"

Conspiracy charges are very difficult to defend against, the government doesn't have to prove very much at all. 

If you decide to make LSD from Fosters beer and then go out and buy the beer, you are guilty of conspiracy to manufacture LSD, a charge that carries the same sentence as operating an actual LSD lab.

They can bust you for having fake drugs, and selling fake drugs, then they can probably bust you for a fake recipe that would yield fake drugs

The fact that the attempt or conspiracy was imposible to accomplish is no excuse under many laws.  In ohio you also get the mandatory minimum tht you'd get if you had actually accomplished the attempted crime- based on the weight you attempted to make..


So if you attempt to make ten grams (carrier  weight included such as blotter/liquid) of LSD with fosters, you'll fail, but will be senteced as if you made ten grams.



From my legal misconceptions thread in security and safety (stickied):


For example, in Ohio, that law is thus:

"
(A) No person, purposely or knowingly, and when purpose or knowledge is sufficient culpability for the commission of an offense, shall engage in conduct that, if successful, would constitute or result in the offense.

(B) It is no defense to a charge under this section that, in retrospect, commission of the offense that was the object of the attempt was either factually or legally impossible under the attendant circumstances, if that offense could have been committed had the attendant circumstances been as the actor believed them to be." See:  ORC § 2923.02 "Attempt to commit an offense."

And thus, mandatory minimums will attach, in many states, based upon the conduct as attempted, not as completed.  So you better be careful how many orange peels you cut up when attempting to brew some LSD, as your speculated yield will determine your sentencing range.

"Based on that analysis, the Chief Justice wrote: “We agree with both the Sixth and Eighth District Courts of Appeals that an attempted possession of drugs is not a separate and distinct crime from possession of drugs, but rather is incorporated into the possession offense. Thus, Taylor was still subject to the mandatory-sentencing provisions of R.C. 2925.11.” See: State v. Taylor; 007-Ohio-1950 (2006)

Note that B) clearly states you can't defend that the attempted conduct was impossible.  So if you intend to rob a bank by using a magnifying class to tunnel in through the outside wall of the building, you are guilty.  And the case I cited establishes that these drug offenses get the same mandatory minimum as if you had actually made your LSD from fostors or whatever nonsense.

My first reaction was anger as well, truth be told I haven't collected myself enough to formulate a secondary reaction.

This is really quite unbelievable.  These kinds of rulings say a lot about our "justice system" and the United States in general.  We're very quickly becoming a totalitarian/fascist state.  I am stuck between incredulity, anger and disappointment.  This is not how things are supposed to be.

Conspiracy charges have become the thought-crimes of our state.  You can quite literally be charged with conspiracy for doing something clearly not illegal, such as engaging in a perfectly legitimate business endeavor.

I love my whizzinator, it really gives me piece of mind at work.  I'm glad I picked one up before the Nazis closed in.
