Best of luck to you man. I had something similar happen to me and they found a quarter on me. After all was said and done, it cost me $100.00 to the court. Could have been worst. Hopefully you are not in one of the states who are real strict with weed. Peace.

That sucks man, but really a lawyer would probably tell you to pay the fine. A judge will side with law enforcement 99.9% of the time.

Sounds like they played close enough to by-the-books that it'd be hard to fight. The guys in the Security/Safety forum might have some advice based on what state you're in, but it sounds like you probably just have to take the charge.... best of luck in resolving your situation.
It sounds like the dog is usually just an excuse to search vehicle, probably indicates a "hit" for everyone .

How does one go about fighting a charge like this? If they haven't written a ticket yet, they're within their rights to detain you (while writing the ticket) getting the dog to come for a sniff. If the dog indicates a hit, that's probable cause for a search.
The only way I can think to fight it is if they don't send the 'cano into a lab to prove it was used on cannabis (since other herbs may be vaporized).

i know for fact that most cops use this tactic just to scare you into getting into your car...my friend's mom and dad are ex cops, and this has also happened to me once, i told them no, he went back in his car for what seemed like an hour, came back out and said that i was free to go

Edit: Looks like I'm only finding that drug dog sniffs are being upheld by different state supreme courts, not turning up a federal ruling. I guess what state you're in could potentially give grounds to fight this charge, but I really wouldn't expect that line of attack to lead anywhere.

Only if they haven't given you your ticket; they need legitimate cause to detain you. If they give you your ticket, their reason for detaining you is gone (if you're in this situation and they tell you you're being detained, ask what for... but most cops know to not give you the ticket until the K9 arrives).

no the law is this they cops are allowed to detain you for a reasonable amount of time for a canine unit i no this a judge told me straight up, the amount of time reasonable of course is subjective 1 hour is definitely pushing it it would seem obvious they would drop that

Except he DID have a reason to search him--the dog indicated that it smelled something.
IMO all that you can dispute is the cops using the dog's indication as probable cause to search your car. As Entropy said, this is something that is not upheld in Federal supreme courts and not in all state courts, so depending upon where you live disputing it (with the help of an attorney) may be worth it.

No. Any amount of time waiting for a drug dog has been ruled unconstitutional.
The 11th US Circuit Court of Appeals has ruled that police may not detain motorists until a drug-sniffing dog arrives unless they have a reasonable suspicion that some crime has been committed. The ruling came in the case of Jody James Boyce, a New Jersey man who was pulled over for a traffic violation on I-95 in Georgia in 2001, issued a warning ticket by Officer David Edwards, but then detained until a drug dog could arrive after he refused to consent to a vehicle search. The drug dog signaled that drugs were present, police recovered 10,000 ecstasy tablets and two large containers of marijuana, and Boyce was subsequently convicted of possession with intent to distribute the drugs and sentenced to 12 years in prison.
He appealed, arguing that Edwards had no lawful reason to detain him after having written a warning ticket. The federal appeals court agreed, granting Boyce's motion to suppress the evidence from the unlawful search and sending the case back to the lower courts, where the state now has no case.
"While we recognize that drug trafficking is a serious problem in this country and we encourage law enforcement agencies to use every available means to control it, we cannot condone methods that offend the protections afforded by the Constitution," Judge Stanley Birch wrote for a unanimous three-judge panel. "The detention of Jody Boyce extended beyond the time necessary to process the traffic violation for which he was stopped and Edwards did not have the reasonable suspicion to justify such a detention. Accordingly, the detention and search were unreasonable under the Fourth Amendment."
The state attempted to argue that Boyce's behavior was suspicious enough to provide probable cause to detain him, pointing to, among other things, the fact that he was driving a rental car on I-95, which it called "a drug corridor." The appeals court wasn't buying, though. That set of facts "would likely apply to a considerable number of those traveling for perfectly legitimate purposes," the opinion noted curtly.
The court also took pains to make clear that exercising one's right to refuse to consent to a search is no grounds for calling in the dogs. "In addition... Officer Edwards immediately called in the drug dog after Boyce refused to allow a search," the court noted. "The immediacy of Edwards' response also indicates to us that the refusal to consent was the deciding factor for Edwards to continue Boyce's detention. The police cannot base their decision to prolong a traffic stop on the detainee's refusal to submit to a search."

Did the officer, walk to your car, tell you he is only going to give you a warning, then ask for your DL, reg and insurance, then go back to his car, then walked back to your car without your DL and papers, and ask for consent, then called for K-9 without returning your papers?

Damn man, fight this with teeth barred. I hate the fucking police and their above the law attitude. Most of them need to be taken out back and relearn how to treat a human being, and the rest need to just realize that they are supposed to be serving and protecting us from real crimes. Police should have to be super super respectful to any citizen. Just being rude to a citizen should be grounds for a write up. We pay them, they are there to protect us from criminals, not commit criminal acts on us and call it enforcing the law.

they act above the law, they have more in common with criminals than the general public.
yeah, i agree that drug laws are ludicrous, they do have to enforce that, but a lot just pull the tell it to the judge attitude after violating your rights, and then whiping their ass with the constitution.
the good cops are hampered by the rest who give good cops a black eye. also i think discourtesy deserves a write up. they should remember we pay their salary.
kudos to any honest cop, to anyone who follows the law.

If the traffic stop was over when he was returning to his car then you'll be fine. I do believe.
But if the stop was not over when he went to his car (to get your ticket written or something) then you could be dicked.
But if stop was over,then you should be good.
