Women pregnant under 18
    #8876068 - 09/04/08 09:56 AM (15 years, 8 months ago)

My state law says that the age of consent is 18.

Does this mean that any women who is pregnant under 18 can be charged? I was wondering because I am tired of men getting in trouble for under age sex all the time and not women.

There is nothing you can do about the anti-male bias in the justice system.

My friend (only friend I trust) was shot twice by his girlfriend, she got probation only, no jail time, if the shooter was a guy there would be no doubt a life sentence would have been handed out, the Judge violated Florida state law that says if you shoot someone with a firearm during the commission of a felony, the sentence is to be a mandatory life sentence.

I went with a friend of mine to pick up his kids in accordance with visitation rules, the mother and my friend got into an argument, the woman pushed the guy, then he pushed back and she fell on her butt, called the cops and the guy was arrested for battery, touch or strike, domestic violence, she was not charged at all even with bruises on his chest and my statement and the victims statement that she pushed first.

He was sentenced to the maximum 364 days MDCJ (jail) and she was never even charged.

I have thousands of other examples from my research on Floridas 11th, 17th, 15th and 16th circuit courts.

Welcome to America.

I was under the assumption that I would get that sort of response. Thanks.

I guess if I ever want to do something I know I have no equal rights.

If a case were actually severe, such as a murder in response to a false rape accusation, what sort of outcome would occur?

Capitol Homicide/Murder
1st Degree Murder
2nd Degree Murder
2nd Degree Murder/Dangerous Act

There is no reason for taking a life unless in self defense, try using legal methods to seek a remedy for your losses.

Well considering the sex happened, the jizz was in her tang, and no condom was used, false rape = done deal. I can't prove my innocence. I guess it doesn't help that the sex was pretty rough too, I wouldn't doubt there could be some sort of abrasions in her vagina.

I guess if I did end up getting out one day, I would have to register as a sex offender and ruin my life anyways. Seems like the only way.

Charged with what?  It is not illegal for a minor to have sex, it is illegal for an adult to have sex with a minor.  A statutory rape charge would be made against the adult, not the minor.

It's not illegal for a minor to have sexual contact with an adult (it is illegal for a adult however), but it is illegal for a minor to touch, fondle, grope or penetrate another minor.

Also a minor may not possess or view sexually explicit photo's of minors/children.

Edit to add: A minor convicted of sexual contact with another minor will have felony sex offender charges on their record for life, along with having to register as a sex offender for life.

That varies quite a bit from state to state, and also does not apply to statutory rape of a youth (puberty to age 17) by another youth.  What you are talking about is sexual molestation of a child by a youth, or true rape of a youth by a youth.

How do any of these crimes relate to a female minor who is pregnant being charged with "underage sex"?  Are you saying that some of these minors forcibly raped male minors in order to become pregnant?

you'd have to know the state really

The law is pretty variable in this area.

In most states if you take a picture of yourself nude while you're under 18 you're breaking the law (producing child pornography).  But you can screw your 50-year old one-night-stand with no problems.

Yes, but taking a photo of yourself in the nude is not likely to result in pregnancy.

depends on the type of photos I suppose

On a funny note my friend got a twenty year old girlfriend while he was only 16 years old..  She wouldn't have sex with him cause she thought it was illegal.  My friend and I looked up the law on the internet and printed it out (from his parents computer, lol) and he brought it to her.

I guess that was so romantic it worked, lol.

Nice candlelit dinner with rose petals, dimmed lights, soft music, and a copy of the Ohio Revised Code section on rape and child molestation really got her fired up :thumbup

I am just adding information to this discussion.

Quote:

Next month, two 13-year-old boys from Oregon will go on trial, facing charges of five counts of sex abuse and five counts of harassment . If convicted, these two could possibly receive 10 years in jail and the distinction of being labeled as sex offenders for the rest of their lives. What horrible crime did these boys commit? They slapped some girls on the butt.

The charges were dropped in that case.  Their behavior also went beyond "slapping butts":

Quote:

The boys, apparently inspired by the movie "Jackass," were accused in police reports of swatting girls on the bottom in a school corridor, grabbing girls' breasts on at least two occasions, teaming up to "dry hump" girls, poking girls' breasts and engaging in what's known as "party boy" dancing mimicking sexual intercourse.

The charges were dropped after media pressure, but we still see that in Oregon, children can be charged with these offenses.

In Florida, touching a child under the age of 16 (older than 12) is a crime (L/L, minor 12-16), but read what I didn't type in that sentence, I didn't add a minimum age for the person that touches to be charged, therefore a 15 year old that touches the "danger zone" of another 15 year old is guilty of the crime of L/L, minor 12-16, a 2nd degree felony with a penalty of up to 15 years in state prison, and must register as a sex offender for life.

Quote:

F.S.A. 800.04 (4)(a)

(4)  LEWD OR LASCIVIOUS BATTERY.--A person who:

(a)  Engages in sexual activity with a person 12 years of age or older but less than 16 years of age;

And when that 15 year old turns 40 years old, they will have a sex offender registry of L/L on a minor, making them look like a real POS for a 40 year old touching a child, when in fact they were a child when they committed the offense:shrug:

However, unlike statutory rape charges, the acts you mention would have to be non-consensual.  Would you agree that someone, of any age, who engages in non-consensual sexual behavior towards another person is engaged in a criminal act?

We're not talking about "playing doctor," but about forcing unwanted sexual contact upon another person.

*edit

Per your Florida law information:

http://offender.fdle.state.fl.us/offender/FAQ.jsp#Question21

This makes it quite clear that the juvenile offender must be over age 14 to be required to register as a sex offender.  Additionally, the offendee must be under age 12 or the crime must involve the use of force.

There is nothing in F.S.A. 800.04 (4)(a) that mentions consent:shrug:

When you mention "non-consenual contact" that is sexual battery, not L/L, you are referring to a different offense completely.

2 15 year olds that play doctor with each other(with consent) are guilty of the crime of lewd and lacivious behaviour, a 2nd degree felony. A 15 year old that plays doctor with another 15 year old without consent commits the crime of sexual battery.

I believe that all forcible sexual offenses should be a capitol felony, so that should clear up my stance on that.

I agree that the law could be read this way, but I wonder whether such incidents would ever be prosecuted?  This situation would not require registration as a sex offender, in any case.

I seriously doubt it, I mean when everyone becomes a teenager and hormones rage, these things happen (meaning kids interest in other opposite gender of the same age), that is a part of growing up:shrug:
