Mushroom-picking season returns in Martin County July 7, 2008 - PalmBeachPost.com
Wet summer weather is bringing out the annual crop of mushroom pickers in rural Martin County, according to reports released today.
Martin deputies arrested three people Sunday for trespassing in a pasture off Bridge Road in the southwestern part of the county, and two people were arrested on land off State Road 714 Sunday night.
Pickers look for mushrooms with psychedelic properties that grow under damp cow manure piles in the fields.
In most cases, the pickers are found on fenced pasture land and are charged with trespassing. Property owners have complained the pickers sometimes cut fences or harass livestock in the fields.
If pickers are caught with the mushrooms that test positive for psilocybin, they can be charged with possession of the drug.

This whole thing is stupid...so...the mushroom itself is fine to grow on the cow shit but as soon as we pick it we go to jail....why dont they put the farmer in jail...and his fucking cows...i wonder if the cow is gong to press charges for harassment or file a restraining order

It wouldn't be a problem for the most part if people would quit trespassing.

Note to FL mushroom hunters!
The FL Supreme Court has ruled that state law classifying psilocin and psilocybin as Schedule I substances does not make it sufficiently clear that these substances are found in common, naturally occurring mushrooms. The Court overturned a conviction of someone was caught with mushrooms but claimed ignorance of their illegal use.
A controlling factor in this case was the person's apparent ignorance of the illegal use of these mushrooms. Also, the mushrooms were fresh, not dried, and there was nothing that indicated he intended to consume the mushrooms.
IF YOU ARE HUNTING IN FL AND RUN INTO LAW ENFORCEMENT:
Do not in any way acknowledge that you know what your shrooms can be capable of. Don't even call them "shrooms." If you have to say something, say "I was looking for rare edible mushrooms for new cooking recipes. I don't know what species these are, so I will identify them online when I get home." Don't elaborate. If you say you have some mycologist friend, you may have to identify him to support you claim later on. If you say you are using a book but can't produce it or even name it, your story may be unbelievable in court. Keep it simple, and if you're not free to go - say you want a lawyer and then shut up!
Most people confess once they're caught. The police say they already know everything or the shroomer gets the idea that cooperation will make the officer more understanding. Sometimes evidence is inadmissible and sometimes a case is a lot less complete than it seems. If you say anything that shows knowledge of the crime, you will seal the case. Stay quiet and get a lawyer. You might spend a night in jail, but if you give them nothing you'll eventually get off. Talk and you'll end up with, at the least, probation and lots of piss testing.
The trespassing charge can stick if you crossed a barrier onto private land, but that's not nearly as bad as drug possession. Some grazing is done on public land too - find out where this is and its a lot harder to get busted for trespassing.

Fucking ask the farmer. I was scared, but I have asked 3-4 times since...Guess what? Haven't been turned down, and I live in Alabama. You know they know what I plan to do.
