What happens if I cash a check that will bounce?

My ex-girlfriend wrote me a check for money she owes me but keeps telling me not to cash it because she doesn't have enough money in her checking account. I know that she has enough money to afford it because she offered to give me it in cash if I visit her. She knows that I am leaving the country in two weeks and probably thinks that I'll let it go if I don't deposit it before I leave. Will anything happen to me if I cash a check from her that bounces? Do I get to keep the money if it does?

It depends on the Overdraft/NSF policy at her bank. Most national banks will pay checks up to a $200 overdraft, and then go after the account holder to collect the money. They will charge an overdraft fee ($25-$35 per check), and send a notice to the account holder of the negative balance in their account. If the account holder does not deposit funds to cover the overdraft, the bank can send the account to collections, and the account holder may be reported to Chex Systems, which provides electronic verification services for vendors who accept checks. Once you have been reported, you remain on their list for a year (I think), and will have difficulty opening another checking account OR writing checks at vendors who use the system.
If her bank is local, or one of the rare national banks without an Overdraft policy, her bank will refuse to honor the check. If you've deposited it into your checking account, the funds will be withdrawn, and your bank will usually charge you a returned check fee ($15-$25).

ya, depends, if the check overdrafts in her account, she gets fined, you get the money, if the account is in the negative, it usually bounces

I have learned from experience that if you are going to leave town, or the country, don't tell anyone who owes you money, especially ex girlfriends.
I have been dicked over by landlords, friends, ex girlfriends, and the sort. If you tell people you are leaveing town, they will string you along till you leave & fuck you for the money they owe you.
In one case i was in a group rental, a childhood friend had moved in, some time had passed & i was leaving to travel the country, i said " dude do you want the washing machine??", he was like, "Oh yes", i said please don't dick me around, i will sell it to you for $25, in 4 loads it will pay for itself if you had to go all the way to the laundrymat. He says, yeah i want it, so i was like, "look, to remove it from the house, i have to take apart the door frame to get it out of the house, so don't fuck me on it. He strung me along, lied to me, dicked me around & when he thought i was to leave on my trip, he says he doesn't want it, thinking i have no option but to leave it there & not get the measily price of $25 out of him.
So........
Here is what i did, i went to the house, had a pair of wire clippers & a nut driver. I let myself in with my key, opened up the back of the washing machine & cliped the wire harness & took out the capasader ( sp?), and left him with a disfunctional washing machine. Some time later when i was back in town, he told me how pissed he was but that i had the right to fuck him back & how he tried to patch the wires, but he never did figure out that i had taken out the capasader & said that he didn't know why the motor had no power, lol, ( stupid bitch)

Worst case scenario she gets arrested for Uttering A Forged Instrument (aka a bad check).
And depending on how good her lawyer is she could face possible jail time.

she will only go to jail if you were to press charges after she didnt attempt retribution, typically anyway. if you were a business you could charge her a 20-40 dollar fee on the returned check...you could turn some profit

forged check is when you unlawfully or without authorization sign a check belonging to someone else, "worthless check" is more commonly used for charges regarding closed accounts or accounts in deficit or insufficient funds

I once cashed a bad check that I thought was good. They charged me $5 for cashing the check! I closed my bank of america account that day.
