Man jailed for drinking tea is free -- after 2 months June 27, 2008 - MiamiHerald.com
From now on, Jerome Klein will refuse tea time.
Klein, 50, was released from Broward County jail Friday after a judge ruled a Bolivian tea he drank was the reason he failed a drug test and violated the terms of his bond.
The tea, called Mate de Coca, made from the coca plant, was given to Klein by his mother just days before a random drug test in April.
He failed the test and was thrown back in jail.
Klein was allowed to stay out of jail while he awaited trial on a burglary charge.
In May, state prosecutors said Klein's urine contained too high a concentration of cocaine to be caused by drinking tea.
But Friday, Theodore Mastos, a former Miami-Dade County judge, convinced Circuit Judge John Murphy III that Klein was the unknowing victim of the herbal brew.
''His mom loaded the guy with the tea. It's full of cocaine,'' Mastos said. ``This was an aberration. He's not a junkie.''
Klein has no criminal history aside from the burglary allegations and has never been arrested on drug charges, records show.
Broward Sheriff's Office lab technicians and state prosecutors had originally agreed with Klein's mother, Shulamit Klein, that the tea was the reason for the skewed drug test results.
But a second look at the results revealed Klein's urine contained 30 times more cocaine concentration than originally reported.
Klein had passed an April 4 blood test but fell ill about a week later. His mother gave him the tea to make him feel better, she said.
''I made the tea. It was my fault,'' Shulamit Klein said. ``I won't use the tea anymore.''

It makes sense that it's legal..Considering Coca-Cola still contains extracts of coca leaves.

His story is probably BS. I find it improbable that coca tea has a high enough concentration of cocaine to cause him to fail a drug test a few days after he drank it. It is a very good excuse though. If I am ever in a position where I fail a drug test due to cocaine use, that will be my excuse. I will even get my mom to go along with it.

according to wiki, "When the cocaine is removed, the amount of cocaine is small enough for the product to legally sell in the USA according to the Single Convention on Narcotic Drugs." Does this mean that most of the cocaine is removed from all coca tea?

I don't think most of the coca teas are decocanized. The one I got certainly was not.
Its not nearly as strong as a cup of coffee but its still pretty cool. And I can drink it at night and go to sleep an hour later.

Coca tea WILL make you test positive for cocaine. I have confirmed this many times with very reliable drug test strips. The concentration of cocaine is low, around 1% in dried leaves if I remember right. However, drinking a few cups of it, especially for regular drinkers, one can test quite high numbers due to accumulation. There was a cop that failed a random UA for cocaine, he had one cup of coca tea the day prior.
As for the LEGALITY: by technical terms, coca leaf is considered the same as processed cocaine, no "lower limit" within detection exists for legal leaf. However, I've heard that drug dogs trained for Cocaine will not detect Coca leaves. Besides all that, priorities of LEO; unless your ordering tons of leaves, no one gives a shit. Nonetheless, we ought to refrain from providing specific sources.
