Boy,13, faces court for dealing crack [IRELAND]

A 13-year-old schoolboy made his first ever court appearance yesterday to face drug dealing allegations after his arrest for possessing nearly €1,000 worth of crack-cocaine, heroin and cannabis resin.
The young boy was charged at the Children’s Court with possessing 11 deals of crack cocaine worth €550, heroin worth €200 and a supply of cannabis with a street value of €110, with intent to supply, at a location near his north Dublin home, on May 20 last.
He also faced a further charge for simple possession of €150 worth of heroin, on June 16 last.
His mother wept openly in court as fears were expressed her son was a tool for criminals who use young children to carry out their work believing they will not face prosecution.
The Director of Public Prosecution consented charges being pressed after previous crime diversion efforts by the Garda Juvenile Liaison Office failed to the deter the boy.
Judge Patrick McMahon heard that the schoolboy, who is on his summer break: would not engage with earlier Garda cautions; was staying out until 11pm; was associating with and being used by older criminals to carry drugs.
Sergeant Seamus Treacy, the Garda divisional Juvenile Liaison Officer, based in Santry station outlined to Judge Patrick McMahon serious concerns he and colleagues had for the young boy.
He said the boy was being “badly influenced by older people” including siblings.
“He is being used by older criminals, who use him because of his tender age,” he said.
Previous efforts to help the boy through the Garda Juvenile Diversion Programme had failed because the teen refused to co-operate.
The HSE had been contacted over welfare concerns for the boy but given its workload the teen is on a waiting list to be referred to social services.
He said he was seeking a remand in custody to Oberstown Boys’ Centre, until today when a place could be available in the National Remand and Assessment Centre, a detention unit in Finglas, Dublin, where educational and psychological assessments of teen defendants are carried out.
Garda Eamon Taaffe said criminals in the boy’s area had “a hold over him.”
Defence solicitor Sarah Molloy said that Oberstown was more suited to older defendants. But there was consent from the boy’s mother for him to be sent to the Finglas centre for the assessment. Pleading for bail she said the boy would abide by a curfew or any other conditions set down by the court.
The mother told the court that she let her son stay out until 11pm which Judge McMahon said was “appalling.”
At one point the mother was in tears and left the courtroom for two minutes while the gardaí detailed serious worries they had that her son would continue to commit crime and about the level of supervision being exercised over him at home.
Judge McMahon said that he would grant bail as a “test” and remanded the boy to appear again today when the teen is to be sent to the Finglas detention unit subject to the availability of a place there.
A 6pm to 9pm curfew was also imposed on the boy.

Obviously its his choice to deal the crack then. God damn, always trying to blame someone else.
