An Easton Area Academy teacher facing marijuana possession charges rejected a plea bargain Thursday calling for a 90-day jail sentence.
Tyson Scott, 33, of Easton, a seventh-grade teacher at the alternative education school, declined comment after the court hearing.
The plea bargain called on Scott to plead guilty to third-degree possession with intent to distribute marijuana. Charges of second-degree possession with intent to distribute the drug within 500 feet of a public housing project in Phillipsburg and possession of marijuana would have been dropped.
Warren County Assistant Prosecutor Tara Kirkendall increased the plea offer to 180 days in jail after Scott rejected the lesser offer through his attorney.
Defense attorney Christy Schlottman also declined comment.
The case is now headed for a grand jury within two or three weeks and the 180-day offer will remain in effect until then, authorities said.
School District Solicitor Alan McFall said Scott remains suspended with pay, a status that will likely not change until he appears before the grand jury.
"It would certainly be my advice that nothing be done at least until the grand jury acts on the matter," McFall said. "Whether there will be any change after that, I don't know."
Scott has been suspended with pay since he was arrested, McFall said.
Co-defendant Adrian Reed, 32, of Phillipsburg, also rejected a plea bargain calling for an eight-year state prison sentence if he pleaded guilty to possession with intent to distribute marijuana.
Police arrested Scott and Reed in April after police reportedly found 4 ounces of marijuana in their possession during a motor vehicle stop. Scott was driving the car and Reed was a passenger, according to a Phillipsburg police affidavit.
The much tougher plea offer for Reed reflects multiple past drug convictions, authorities said.
Reed would have to serve 27 months in prison before he could apply for parole, under the terms of the rejected plea offer.
Authorities would have dismissed charges of possession with intent to distribute the drug within 500 feet of the Phillipsburg housing project and possession of marijuana.

"Authorities would have dismissed charges of possession with intent to distribute the drug within 500 feet of the Phillipsburg housing project and possession of marijuana."
What the hell... 500 feet of housing projects? First they do it for schools then they starting doing it for residences? This is double jeopardy. Why don't they just add intent to sell within 500 feet of a gas station, fire hydrant, etc...
