Restaurant owner pleads guilty to drug possession [AUSTIN, MIN]

A local restaurant owner charged in a drug case that was reinstated this winter after it was dismissed last summer pleaded guilty to possession of cocaine in Mower County District Court Monday.
Scott Alan Johnson, 47, pleaded guilty to a single count of second-degree drug possession as part of plea deal with the Mower County Attorney’s Office. Two other misdemeanor charges — open bottle in a motor vehicle and possession of marijuana in a motor deal — were dismissed.
Johnson, owner of Jerry’s Other Place, was arrested Nov. 15, 2006, after two officers discovered 10.5 grams of cocaine in his wallet and a small amount of marijuana and two open bottles of brandy in his truck, according to the criminal complaint.
Police searched Johnson and his vehicle after an officer witnessed an alleged drug transaction involving the defendant and a “known” local dealer. Johnson was pulled over several blocks later for running a stop light, the complaint said.
Six months after the case was filed, Mower County District Judge Donald Rysavy ruled that police lacked probable cause to search the vehicle, thereby pulling the cocaine found as evidence and dismissing the case in June.
Police had argued that they requested a canine search and asked Johnson to step out of his vehicle because of Johnson’s behavior, which they called “furtive” and “nervous,” and because of the alleged exchange with the drug dealer.
Rysavy said Johnson’s behavior was typical of anyone pulled over in a traffic stop, and said police had no basis to believe him a drug user.
In January, a three-judge panel in appellate court reversed Rysavy’s order, stating that officers had “reasonable and articulable suspicion of drug-related criminal activity” due to, among other reasons, the visual presence of marijuana in Johnson’s truck.
A request for further review of the case by the Minnesota Supreme Court was denied in March.
Johnson’s sentencing is set for Sept. 5.

I bet he didn't run that stoplight if they had information that he had just purchased drugs. They just needed a reason to stop him.
And his walled must of been bulging.
