Well, some would say that Frank Zappa sucks too, but who am I to judge. Water boarding is definiely worse than Zappa though.

we prosecuted our own soldiers in vietnam for waterboarding viet cong...why would we have done that if it wasent torture?

US Generals are not authorized to designate something as illegal, they can only prohibit it as military policy. Waterboarding is already proscribed as military policy. The CIA is not the military.

Further, the military is not allowed to do a whole lot of things to POWs that are not remotely considered torture. The fact that the military does not do something does not necessarily mean that the thing they don't do is torture.

The generals didn't just proscribe it as an individual act, it was banned because it broke the Geneva Convention, the United Nations Convention Against Torture, and the Universal Declaration of Human Rights. It's torture because it fits the definition of torture: "any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity. It does not include pain or suffering arising only from, inherent in or incidental to lawful sanctions."

My ex-wife's voice on the phone qualifies as torture under that ridiculous definition. It renders the word meaningless.
