McCains financial dilemma

so tell me if I got this right guys.
McCain applied for matching public funds for his campaign. doesnt use the money, but does use it towards collateral for his million dollar loans. Now, there is a 50 millino dollar cap that a candidate has to adhere to once they use public matching funds... but since he isnt directly using the money, but indirectly using it as collateral, a committee has to decide whether or not he is going to be held to that spending cap.
the biggest problem is that McCain has already spent 49.65 mil already. which would leave him with less than a half mil for the next 6 months. if this happens it would basically cripple the republican party, because he is going to win the bid no matter what and then have to rely on skimpy swift-boat-esque commercials for publicity.
im interested to see how this pans out. Anyone else have any other info on this, because it seems to be overshadowed by the juicy gossip involving his relationship ith a lobbyist.

right.. but the other day I was listening to NPR and the dilemma is that he used the public funds as collateral for loans. which means that he did in fact use the public funds, even though he didnt spend the money. so now that is being looked into on whether or not the cap exists on him or not.

OK OK OK. I shall explain. McCain doesn't need to spend another nickel to get the nomination and these current limits apply only to the primaries. You essentially have the whole matching guarantee as collateral correct. Another interesting twist is that there are only 2 FEC Commissioners when there needs to be 4 to make a quorum. The FEC can't really do anything at all until the Senate and Bush get together on appointments.
I am going to repeat the most important part though. These limits do not apply to spending on the general election at all.

right I heard about the commissioner part as well. the nominations have supposedly been in deadlock for a while.
but how do you say that this commercial is for presidential election and this one is for the primaries? if this hillary/obama thing goes on like some analysts are predicting, will that still consider the process, even on the republican side, to still be in primaries?

I imagine once he has the delegates locked up the primary is over. I don't really know that though. At any rate, it might well be to his advantage to just keep his head down and let the two of them go at each other tooth and claw for a couple months. Truly Zen, killing without killing.

Which amazingly explains the tremendous landslides the Republican President has lost the last two elections by.
