Problems with 3rd Generation Ipod Nano

So i got me a 3G nano to replace my gen 1 shuffle, it's pretty cool and all being able to scroll though the music and watch vids and shit. Anyway, some of the songs will start to play, then it just skips to the next song, like the file is corrupted or something. I know the songs are good, cuz they play on the computer. Here is where shit gets confusing though:
A) I can play them off of the Ipod through Itunes just fine
B) If you fastfoward, the songs work fine wherever you stop to play the music for a few seconds, then it cuts off again. There is no standard for how much of a song will play. Some play for 17 secs, some for only 1.
Any one have any thoughts on this? I've tried "syncing" a bunch of times and that doesn't work. Next I'm gonna try removing everything from the Ipod, resetting it, and then reloading it. My software is up to date.(Version 1.1) I tried searching google, but haven't found any similar issues except for people using the +Nike kit, which I am not. Any one have any thoughts? Will post back as to how the resetting goes. If I have to send this damn thing back, would I send it to Apple, or carry it back to the store I got it from? The thing isn't but about a month old.

Restoring to factory settings did not help.

I've tried that, that's part of the whole "restore" process, and it didn't work. Same songs too.

For the record, I did a bunch of checking around, and converting the songs to AAC in iTunes and reloading to the iPod, although a hassle, does fix the issue. Still no word on why it does it though, it just seems to pick random songs and f 'em up.
