Man this blows, the week I decide to start using torrents I get fucking slammed with a letter saying im getting sued. And Im a broke college student so Ive got no cash to spend on anything for a long ass time. How do people still not believe that the world is out to get me?

I dont know how much its gonna cost, but I got a letter from charter communications say they have data proving a computer at my home downloaded this and I will be contacted by copyright people blah blah blah Anyone have any guesses at what it may cost?

even if this is happening, it never really makes sense to me why they would come after someone who just just downloading one thing, or has only done it a few times, obv if they have 'proof' that he's not hording pirated material and stockpiling torrents, and seeding thousands of things. I mean what a waste of resources, what are they gaining? I mean granted Im sure they'll try to sue you for a ridiculous amount and then naturally either settle in or out of court with something like 20k. But it really just doesn't make a whole lot of sense why charter would come after you . I could see some third party company designed to hunt pirates, and maybe subpoena Charter for such information. All just seems a bit strange. Personally I'd like to take a closer look at all the details, you should elaborate a bit more if you could son. Fill us in, its too you're benefit.

also tell us details.
if your parents have a wireless network and you downloaded it on YOUR laptop or computer that you took back to school, they are in the clear.
just say its an unprotected wireless network.
if you downloaded it on your parents computer, i'd definately wipe it as soon as possible in case it does go to court and they could use it as evidence.
another defense is buy a used copy of the office season you downloaded it and say you had the right to download it and you assumed the others downloading it also had that right. backup copies are allowed, but i think it might be a legal gray area now.
edit: and do not admit to a thing. claim you are innocent and argue with them. do whatever you have to do. you will get out of it i'm sure. read about the recent case against the RIAA vs some mom who supposedly downloaded rap. they failed horribly.
and remember, last resort is to get rid of the computer all together (or at least the hard drive unless you do like one of those crazy ass 8x format jobs where they cant recover shit). if no murder weapon is found... 
edit2: see a lawyer before you contact them at all!

THanks for the advice guys, I am not even sure of the details because I got the news from my dad who got the letter. Basically I was at home over winter break, downloaded it on my laptop on our wireless home network, and today I got the letter.

they'd still get you for distrubting though as far as i know unless you claim innocence, which might not work.

How can they subpoena you just for having evidence that you 'did' it without having anything empirical? To me this just doesn't add up, get a lawyer he'll say the same. Why wouldn't they get this 'data' that obv show's you've been pirating and then get a warrant get inside your house confiscate all the things need to get substantial evidence and then press charges.
Things don't make sense. I wouldn't agree to shit, without a lawyer, don't say shit, if they call say you're not talking without a lawyer present.

it's most likely a fee they are trying to charge, much like the riaa did awhile back. basically in that case, if you don't pay they fee, they are saying they might sue. however it's not a settlement of any kind. you could pay the fee and they could still sue.
that's most likely what this is. but who knows, time will tell.

I would highly doubt Charter Communications is suing you. I am a Charter customer myself and I have also received letters from them (twice now), detailing what copyright protected material I allegedly downloaded and when. These letters have only served to warn of potential termination of service. If your dad just skimmed it, it is possible that he is jumping to conclusions since the notices are fairly lengthy and include technical data which exhibits the connection between your IP address and the file transfer in question. I wouldn't worry too much 'til you get a clearer understanding of the notice. Still, it would be a good idea to find that old copy of The Office you lost several weeks ago.

Charter is not threatening to sue, they are threatening to cancel service and it sounds like the letter said I will be contacted by the copyright people or something

I got an infringement notice from Comcast for downloading Season 3 of The Office too. I'm not getting sued though, it was just a warning letter. I wouldn't sweat it if I were you, just be more careful.

Wow, what a weird coincidence. Just yesterday my sister calls me on the phone while im at work. Now usually, she's asking me techinical questions on how to convert movie torrents or burn them or something. Anyways, she tells me that her DSL had stopped working and she got a call from someone at the DSL company saying they know she's been downloading copyrighted movies on the internet (shrek 3). She just played dumb, saying she doesnt know much about computer and said it was probably her son who did it (he's only 3. lol) In the end, they just wanted her to delete the movie and they turned her DSL back on.
So, i think the worst case scenario is you might loose your ISP but i doubt it. They want jo0r moneyz.

I know of an easy way to save yourself! Go out and buy that season of The Office, because it is legal to download something you already physically own. 40$ sure beats thousands+ legal fees.

Format the hard drive, reinstall Windows, then open up the run command.
Type:
CMD>ENTER IPCONFIG/RELEASE>ENTER IPCONFIG/RENEW>ENTER EXIT>ENTER
Unplug your modem for 24 hours, plug it back in. Call Your Internet Service Provider, tell them to go fuck themselves for invading your privacy, and prove I did anything wrong.
Also hint to them your lawyer would love to raise a lawsuit for invading your privacy and harassment.

That's all horrible advice. Formatting it and reinstalling Windows is not going to stop anyone who knows what they're doing from looking at any data that has ever been on your hard drive, and renewing the IP through CMD only changes your local IP address. You fail. You have no idea what you're talking about.

I GOT THE SAME DAMN LETTER!......except from Rogers wireless...and about Battlefield 2. Story is that I actually own a copy of this game and I lost disc 2 of the 4 they come with so i couldn't install without these iso files. They wrote me a letter threatening to cut off my service, I sent a 2 page long response letter which did get me an a apology but sadly I don't have the time or effort to dig it up again.

and if you search google or even simply look at wikipedia, you find there are hidden costs, you only get one letter per incident, so you pay for any after that, and many, many other things.
not to mention it is a pyramid scheme. supposedly, if you start selling they force you to go to meetings and buy materials that cost money, and more than likely you'll lose money.
but hey those of you who like it, if it'll make you guys feel better to waste your money on it, go for it.

I reviewed my policy and they can only collect that sort of information by court order (Suddenlink here). I'm dismayed to find out however that they can "packet shape" me. They sure as hell better not try that.

Local laws? Maybe. There is no federal legislation that says ISPs can't do whatever the fuck they want when you're using their equipment. It differs from ISP to ISP.

In almost all cases, it is not your ISP that is snooping around trying to track you. What happens is this:- You connect to a Peer to Peer network for file sharing
- Every other peer that is sharing the same file you are sharing (downloading), has access to your IP address
- One of those peers is representing a media agency (the RIAA and NBC Universal are notorious snoops)
- They record your IP, the date/time and which file you were transferring to or downloading from them
- They send the report to your ISP
- For the ISP to prove they are not negligent, they must deliver to you a cease and desist letter
Trust me, it's happened thousands of times and so far, almost no one has actually been sued. Not to say it can't or won't happen, but the strategy at present is to scare people into quitting the whole file sharing scheme, or to get their ISP to shut off their internet on repeated offenses. Even so, I know of people who have received upwards of FOUR notices and still have their ISP connection active.
Take it as you will... As a general rule, you should avoid public trackers such as Mininova and TorrentSpy, especially when downloading new release material that was produced by a major media company (including major network television shows). I know for a fact that FOX and NBC Universal watch mininova quite closely... so do your downloading from a private tracker (one which requires registration), and if you really want to be careful, stick to relatively obscure material that isn't likely to be snooped upon. The more peers are connected to a given torrent file, the more likely that one of them is snooping.
