Rights if renting a house
    #7933844 - 01/26/08 07:14 AM (16 years, 6 days ago)

I was wondering, what are the laws concerning search and seizure if one rents a house as opposed to owning it?

They are exactly the same thing. Even your landlords cannot come inside without permission unless there is some sort of emergency (a gas leak or something).

Ah yes, the World Wide UN law that extends protection to everybody in the world.

Completely dependent upon where you live. The rules can change from city to city. In some cases, you have the same protections that a home owner would have. In other places, you have few (if any) protections.

Its better to rent, that way they can't take it from you.

If you rent a house, its probably as secure as owning the house when the cops come to the door.

Once I was in an apartment in Chicago and the cops knocked and they had the landlord there to let them in if we wouldn't. I guess apartments are a bit more sketchy.

lol, seuss hit on my pet peave, people extending their local laws to the entire world.

anyways, generally the police must recognize anyone who rents, or even stays in a place w/ permission from someone w/ possesory rights, with the same rights as someone who owns the property under the US Const.

The only fudge point is that localities have different laws as to when a landlord can enter, and generally if the landlord can enter, then he can allow to police to do likewise.

So 1. read your contract
2. read your local and state laws.
3. w/out landlord consent, and maybe even with, the police are in no different situation than with an owner as compared to a renter.
