Busted downloading a file
    #7930927 - 01/25/08 05:04 PM (16 years, 7 days ago)

I got this in my email today...should i worry? How can I continue to download stuff without them knowing? I have only had this internet for a little less than two weeks...lol...anyways, here is a copy of the email

Dear Subscriber:

This email is being sent to you by Road Runner Customer Care
because we have received a complaint that your computer has been used to
distribute copyrighted material without authorization through a
peer-to-peer program. We received this complaint from the movie studio,
record company, television studio or other company that owns the
copyrighted material. The purpose of this email is to remind you that
the distribution of copyrighted material in this fashion may violate
both the copyright laws and Road Runner?s terms of service, and to tell
you a bit about peer-to-peer programs, the dangers they can pose to your
computer and our network, and the steps you can take to protect
yourself.

A computer can become accessible to a peer-to-peer network for an
unlimited period of time after a peer-to-peer program is downloaded.
You may not even be aware that such a program is on your computer; a
child or a visitor to the home could have downloaded it. That is why we
want to alert you to this issue.
Peer-to-peer programs may contain many problems. For example:
· Downloading and offering for upload copyrighted material without
authorization is unlawful. If you or others using your computer have
been doing this, you could be subject to civil penalties and criminal
fines. Such activity also violates the Road Runner terms of service.
· The programs allow any anonymous person on the Internet to look at
your computer files and copy them for themselves. Such a hacker could
view all of your files, which can lead to identity theft.
· The programs, which use large amounts of memory, can interfere with
the functioning of your computer by destabilizing your operating system,
leading to a general sluggishness at bootup and during operation.
· The programs can contain spyware, adware, malware, viruses and
pornography.

If you are interested in a discussion of problems associated with
peer-to-peer file sharing, please follow this link:
http://research.pestpatrol.com/whitepapers/p2p_impact.asp.

If you use the Windows OS, the best way to remove peer-to-peer
programs is through the Add/Remove Programs tool. Other removal options
are discussed at
http://security.uchicago.edu/peer-to-peer/no_fileshare.shtml.

Thank you for subscribing to Road Runner.

Very truly yours,

Road Runner Customer Care

Re: Unauthorized Copying and Distribution of Copyrighted Audiovisual

Dear Sir/Madam:

I am contacting you on behalf of the Motion Picture Association of
America (MPAA) and one or more of its member companies.

We submit that the MPAA is authorized to act on behalf of its member
companies (the MPAA Members) with respect to the matter described in
this notice. The MPAA Members own intellectual property rights,
including exclusive rights protected under copyright law, in many motion
pictures, television programs and other audiovisual works (collectively,
the MPAA Titles). We believe that your Time Warner Cable Internet
account is being used to reproduce and/or distribute copies of one or

501. This conduct may subject you to significant liability, including
statutory damages of up to $150,000 per infringed work for willful
infringement. Under certain circumstances, copyright infringement can
give rise to federal criminal liability, with penalties as high as five
years imprisonment plus a $250,000 fine. (See 17 U.S.C. ' 506; 18
U.S.C. ' 2319.)

Such infringing activity also constitutes a violation of Time Warner
Cable's Abuse Policy/Terms of Service Agreement, and such breach may
give Time Warner Cable the right to terminate your Internet access
service. We therefore demand that you immediately:

1) Cease any unauthorized offering or downloading of the above title(s),
and any other film or television titles whose copyright is owned by the
MPAA Members, on any peer-to-peer or other internet services; and

2) Delete from your computer any unauthorized copies of the above
title(s), and any other film or television titles owned by the MPAA
Members, which you have downloaded from or offered on any peer-to-peer
or other internet services.

You can learn more about piracy by visiting the MPAAs web site at

Very truly yours,

I have gotten two of those in my lifetime.

The only sure fire way to not have your isp bitch is to not download. But there are other things you can do...

Use private trackers, not public ones. Public ones are more vulnerable.

Use PeerGuradian and update the P2P blocklist frequently.

Stay away from hot, new downloads. Those are watched most frequently. ( I was busted for DL one of the harry potters as well!)

I was busted when I was with Cox Communications. They got an e-mail from Paramount for sharing some movie(don't even remember). The security guy from Cox told me that if it happened 2 more times, that they would cancel my service and ban me. That's when I switched to TV shows, lol. I'm a big fan of updating IP filters. The client of P2P I use has an option to integrate it into the GUI. I would also see if you could get DSL, mainly because they have a dynamic IP instead of a static one.

Yes US. No anything else. As it stands, most ISPs (including mine) have a policy of privacy. They wont give away your information without a warrent. So the copyright holder doesn't know who you are. You are only in trouble with the ISP.

good...i knew not to contact they MPAA directly, as they would then have my information...but i did send an email to my ISP asking if they gave out my info and for a copy of their privacy policy.

Is time warner associated with warner bros in any way?

peace

edit:  forget about that question, they are.  Not only that, they are the ones that make/back/whatever the fuck the movie companies do, with harry potter.  oh well, worrying wont solve a thing, guess my movie downloading days are over :frown:

unless i can somehow figure out usenet, anyone want to pm me/show me how to do it?

peace

u should let the mods there know. they may be able to track something down and get rid of the problem. the group i ran off we found b/c of a comment one made, then we noticed a whole invite tree was seeding the same torrent, so if one got banned, they had five other accounts to keep going w/. the person that originally reported them told me, "they are obviously not here to make friends". i responded to him, "let me know if they did make friends so i can ban them too."

I think this only happens in the US isnt it?

I have never got such an email and would just respond by saying I owned the original and wanted to download a backup copy.

well, even backing up your own copies can be considered illegal. The RIAA and MPAA have made a mockery of the fair use laws. It even says on the cases of dvd's here that any copying is illegal and will be investigated by the FBI...

well the owner of oink lives in london and his door got kicked in by the po po's.

as far as peer guardian goes. after installing and running go to list manager. click add and there is a browse file or url option. there are 20 list in the drop down url menu, one by one select all of them. after that go to the main screen for pg2 and check updates. if u did it right, it should say 20 list up to date, 0 disabled. this will use all the pg list as well as all the bluetick list.

can a mod please erase the last post as most of it is fit for an article on snopes. anytime u d/l w/ utorrent, the person u are d/l'ing from can see your ip. that is how they get cha. if the place u search or get torrent files from is public, your chances of getting caught are even greater.

if u want to minimize risk, use private sites. run pg2 w/ all 20 list enabled. waiting to d/l the new movie does no good, the people that are watching can seed forever. canada is not a safe haven, as demonoid.

blah its late at night so i dont want to read through all those posts. this isnt about downloading this is about sharing. Its alright to download just dont let other people download off of you or you will get busted. paramount pictures busted me for downloading jackass through a torrent. The problem with torrents is you have to let others download off of you, unless you use limewire which now supports torrents. The problem is you have to shut off like 8 different sharing options on limewire (they are hidden to trick you) to make it so you only download and dont share.

even when u just d/l u reveal your ip to those who are seeding (could be the po po's). the only way to be safe is to not pirate. i have seen the bad forces of nature use some freakish tactics to bust people. the best advice i can give is to use pg2 w/ all 20 list activated (amounts to wearing a condom) and use private sites only. i used to say only use utorrent 1.6.1 but now some of the best private sites have banned it, but if u don't use those sites, it doesn't matter, use 1.6.1.

"hot hew downloads" does not matter. the mpaa can seed a torrent forever, or limewire, or kazza. your best bet is to actually get on it before them, from a private site. they also don't just jump on one release, they jump on all of them. stay off of public sites (the bay). use peer guardian w/ all 20 list updated.

You saying that the new Harry Potter movie is just as dangerous to DL as some old western like A Fistful Of Dollars? I dont think so.

I have encountered a dozen or so of these letters from friends and myself, every single one was from a recent movie, video game, etc. My opinion: corporations arnt watching torrents like the original Outer Limits, or the Mamas and the Papas nearly as much as new albums and new shows. The new stuff is where the money is, and is where their money is being lost.

i'm saying who wants to d/l a freaking western. the whole reason people pirate is to get what they want. if u want to get what u want, stick to private sites, use pg2 w/ all 20 list updated, and only keep a modest ratio. i belong to a huge list of private trackers and know people from all the major trackers and we don't seem to get these letters almost ever so i'd have to imagine we have a winning formula for now.

I'd say the easiest way to stay under the radar is to stay AWAY from Torrents, and P2P Networks.

ISP's can track the packets that come through thier gateway, as they are unique.

If you download from sites like say, ones that offer "Direct Downloads", it will only show up on the ISP's end as a TCP/IP packet (a common internet protocol packet, exactly the same as what loads your web-browser).

It's worked for me for years.

The WORST that I have ever gotten was a "mandatory upgrade" from my ISP because i was using too much bandwidth in a month (739gigs to be exact...LMAO) so now i pay $20 a month more and i got off the hook.

I like how the MPAA's letters state that you can go to jail for downloading a single movie, when you clearly can't. With all the lawyers over there they should be able to fix that email up

That letter seems written by a jackass anyways.

What is this: a hacker could look at all your files and lead to identity theft bullshit?

Oops, forgot to unshare my "this is my bank account and credit card and social security and ID and all my fucking passwords.txt" file

newsgroups all the way. anonymous, fast, most current, etc. plus there is NO UPLOADING INVOLVED. Take a moment to think about what that means. It means you are not leaving a trace of your actions behind, and you are not making yourself vulnerable, like when you upload something (as is the nature of torrents / limewire / dc++ / and all other p2p methods).

The only downside is that newsgroup subscriptions cost money. I love usenetserver.com (unlimited plan = $40 for 3 months) and giganews.com (expensive, but 2x the retention).

for more info on newsgroups, check out this guide, it's the best you will find:

thats what is funny about TW, they may forward the letter from the MIAA or whatever, but give me free news servers, i think giganews actually...lol.

4 connections and 75 day retention...i can't complain...lets me download anywhere from 300-800KB/s...so its good.

i wouldnt use the ISP's newsgroup access. I doubt they are giving you a giganews account. They are giving you a TW usenet account, which is NOT anonymous. Although, I don't think TW is the one policing, it was probably someone with the MPAA/RIAA that found you on bitTorrent and reported you to TW.

Still, I would suggest going with a third party for newsgroup access.

edit:  forget about that question, they are.  Not only that, they are the ones that make/back/whatever the fuck the movie companies do, with harry potter.  oh well, worrying wont solve a thing, guess my movie downloading days are over :frown:

unless i can somehow figure out usenet, anyone want to pm me/show me how to do it?

After reading all this tread, i was curious why the option hadn't come up with other ways of downloading files.
Some sites use 3rd party hosts that hold the content, and when you download the file, it just looks like a string of numbers (ie. adrive.com/2399e880923de909e2d320) and then the watchdogs don't know what your downloading except that it is a large file. If for some reason they ever catch on, all that would happen is the file host is contacted and asked to remove the file...then the link goes dead.
And most of the people that are within the movie share networks out there don't label thier movies that they share with anything that could identify it as a movie at all.
As for the ISP's. I'm not sure how it works anywhere else, but in Canada they don't give your info to anyone. The only complaints that i have EVER heard from anywhere (after over 10 years of downloading movies) is 2 warnings for going over my bandwidth usage for the month first warning -(i was 329gigs over)
second warning -( i was 758gigs over) which they gave me the option of cutting me off, or a manditory upgrade to the next bandwidth package (for a meer $20/month extra).

There is no way that the MPAA could download and check every file out there that they suspect is a movie file, so that is how i've gotten away with it for years.
This works so well that i made a site that links to this sort of content (plus linking to content isn't illegal as long as i don't charge money for memberships, but donations for site maintenance is allowed)

I'd suggest looking for other ways than the torrents and P2P's....way too risky.

Plus there is always the option of going to sites that stream DivX movies. Then you just configure your player to download the file while it streams...then you have a copy and it looks like you just watched it online vice downloading it (it ends up showing up as a " .part " file, but any DivX or Media player will play the file with the basic DivX codec pack)

> and then the watchdogs don't know what your downloading except that it is a large file

If you really think that the 'watchdogs' catch you by looking at the filename of the item that you are downloading, then you are in for a very rude awakening... they are collecting evidence that must withstand the rules of evidence in a court of law.  They aren't playing around, and closing your eyes hoping that they won't see you isn't going to help.

> If for some reason they ever catch on, all that would happen is the file host is contacted and asked to remove the file...then the link goes dead.

Assuming the recording industy isn't the one that owns the host in the first place.  You are blindly trusting the host, something which you do not control, for your safety and security.  Not the best practice...

> There is no way that the MPAA could download and check every file out there that they suspect is a movie file, so that is how i've gotten away with it for years.

No way, huh?  Again, you are playing with other peoples freedom based upon your own assumptions.  Not very ethical.  There are companies that exist to do nothing but search and destroy copyrighted material being pirated on the internet.  Companies, plural.  This is a huge market.  They mostly concentrate on new releases, but that doesn't mean they don't watch for old stuff as well.

You've gotten away from it for years because you are in Canada and you are lucky.

> Plus there is always the option of going to sites that stream DivX movies.

Again, you have to trust that the site is legit and not a honeypot owned by the recording industry.  (Something which they have been caught doing in the past in the form of a torrent tracker.)

> it ends up showing up as a " .part " file

That is because of the client software you are using... could easily be different for people using alternate software.

All of that, and you didn't mention NNTP?

(Sorry if the above sounds terse.  I don't like to see misleading statements or assumptions when it comes to peoples freedom.)

where is utorrent banned?  it is the #1 most recommended client by every major tracker that counts for anything.

I've downloaded probably a terabyte or more of shit off public trackers over the last decade, and I've never gotten such a letter.

you're half right, but all the nerds that use utorrent haven't been able to find not one stitch of legitimate evidence that utorrent does anything it isn't supposed to be doing makes me think it is safe.  to be more accurate, bittorrent was given to the mpaa, then utorrent was bought out by bittorrent, so it's more like the company that owns  utorrent is owned by the anti p2p company.

>  to be more accurate, bittorrent was given to the mpaa, then utorrent was bought out by bittorrent

Bram Cohen created the BitTorrent protocol and started a company called BitTorrent Inc.  In December of 2006, BitTorrent Inc announced that they had purchased µTorrent (written by Ludde Strigeus).  BitTorrent Inc started working with the MPAA on November 22, 2005, more than a year before BitTorrent Inc purchased µTorrent.
