The only way the camera would be wrong is if the technology wasn't working right or if someone ELSE had the EXACT same license plate as you with the EXACT same make/model of car. I doubt a judge would find either one of those very likely. A lot of speeding cameras will not only take the photo of your car and license plate number but ALSO a picture of *YOU* yourself in the driver's seat to prove it was actually you. A buddy of mine had thi s happen to him.
It's still not physical, concrete proof. You know what I mean. I'm just arguing a technicality. I understand the technology and where you're coming from.

Yea but if you're going to say that isn't physical proof then you have to say the cop's rader guns are'n't physical proof because they use the same technology.

Cops don't need proof. I was convicted of a crime I did NOT commit based solely on circumstantial evidence. I'm currently waiting on an appeal that will go before a jury instead of just a district court judge like the first trial.
$500.00 is to high imo but people do need to shut up and drive. The hands free thing is no good. The problem is not a lack of hands on the wheel. The problem is divided attention from the outside conversation. It's not the same as talking to someone who is also in the car with you. Likely someone also in the car with you is also watching the road and following along better when you momentarily shift more concentration to driving when needed.
Wrecks are not the only problem either. I've noticed that a lot of people subconsciously slow down while talking on their cell phone. I despise getting stuck behind someone poking along below the posted speed while yakking away on the phone. Makes me want to get out at the next stop and ram it down their throat.

you cant cross examine a camera on the witness stand, you also are not given ample opportunity to have the calibration tested on the scene of the infraction cops have to allow you to record certain info form their machine, show you it's been calibrated and working properly, etc... you can beat that too but it's a different can of worms

hey pris. what exactly should one say to a cop to get this info? what is the best thing to say to a cop when being pulled over for speeding? ive had so many damn tickets in the last 2 years i should probably learn the technicalities and what to say......

first thing to remember is to try not to stand out in his mind, he'll remember you in court otherwise, usualy when you're pulled over it's best to stay put, have your papers ready and turn on your interior light, give him some reason to feel safe when approaching the car
cop steps up and usualy says "know why I pulled you over?", no sir is the best answer, he'll inform you of your speed and generally offer to show you how the radar operates by clocking another car or a tuning fork, they call it a calibration test, if the officer uses a tuning fork, ask him what key it's in, unless he's a musician he'll be clueless, tell him it's stamped on the end. keep the banter friendly and short, never more than they need to know.
while it's best to handle most stuff on the scene theres somethings you'll have to do after the fact, recording the make and model of the radar unit, it's serial number and it's service/calibration records, this is done by filing a motion for discovery, it needs to contain anything you believe to be pertinent. Some things to consider is the officers certification on the use of the radar gun, the standards set by the US Government for the tuning forks used. (I believe there was never one set, may have changed though) Without that standard which all will have to match in frequency it's inadmissible as evidence

plead not guilty, present your case, hopefully theres enough to dismiss the evidence and possibly discredit the witness, for instance if a friend goes to get the info on the radar unit, the cop will remember him beforehe does you, have him point out the guy that got the ticket
think like a lawyer and learn the laws in your area, be nosey when it comes to cops

Pictures can't provide sufficient proof of the violation committed period. This is why every traffic camera speeding violation can and MUST be thrown out if taken to the state court level. If there's no officer present to witness said violation, it is in fact illegal to send a ticket.
Not only that but they send you the ticket in the mail. This is also illegal. You have to be properly served by a person that can verify the ticket was put into your hands.
On top of THAT the violation has to be signed by a human, which these aren't. They're all signed via the same electronic system that is set up to take the pictures in the first place.

I wasn't exactly trying to get sympathy, just saying it kinda sucked. Resulted in a bunch of other fines that were all my fault. I just wasn't pleased with the way the judge treated me.

I have handsfree in my car. Does that mean that from the factory being able to talk through your car, is illegal? I feel like its a thing on how bad of a mood the cop is in when he encounters it.
