Swat team raids Silver Plume home

In early November, an armed Clear Creek County sheriff’s tactical team raided a Silver Plume house looking for a suspected marijuana farm. The four-hour raid that took place at midday on Main Street in Silver Plume turned up no marijuana and a handful of drug paraphernalia. The raid was sparked after a two-month investigation by sheriff’s Detective Jim Woolf into 33-year-old resident Todd Maxwell. The investigation began in mid-September when a sheriff’s deputy went to Maxwell’s house to serve civil papers and observed what he described as strange and bizarre behavior from Maxwell. Instead of coming to the door, the deputy said, Maxwell “crawled” out a window and “slithered” across the roof to retrieve the papers. A few days later, a Gilpin County deputy reported that, during a routine traffic stop, Maxwell was found with 5.9 ounces of marijuana. Over the next two months, Woolf used a search warrant to pull Xcel records on the house to determine if there was excessive usage or variance in electricity. Woolf said he observed a bright light emanating from the basement of the garage that he concluded was consistent with lights used to grow marijuana. The electric bills also showed a two to four times higher electric bill compared to four nearby homes. Woolf obtained a search warrant Nov. 1, and the house was raided the following day. Police found $1,400 in cash, eight unidentified pills, various smoking pipes, books and manuals on how to grow marijuana, and 25 to 30 plastic pots consistent with those used to grow marijuana, the report said. No marijuana was found. Maxwell was charged with possession of drug paraphernalia, a class 2 petty offense, which carries a maximum fine of $100. Maxwell appears in court Jan. 8.

cuz they didn't want him to panic and clean up the house. Better to let him think it was no big deal and let him go, then gather evidence of what he was doing to get all of that- bigger charge.
You can always indict later, but perhaps they felt they didn't (or tried and couldn't) get a warrant for his house.

Whats really wrong with this is how he compared the electricity bill to four other houses in the area. He needed a warrant for the one, how did he get one for the others with no probable cause or any reason for that matter? Also it sounds like they were just snooping around looking in windows and stuff, so stupid. You think that was a routine traffic stop too? lol.... damn

you dont need a warrant to get access to electricity usage. any joe blow can walk up to the power company and ask for them.

Bizarre isn't illegal, but certain types of bizarre can be classified as suspiscious behavior or even probable cause. If you're a cop knocking on someone's door, and you see someone peeking through at you and then climbing out of a window to talk to you... that's pretty damn susipiscous.
Sure, people are protected in their homes from allowing cops to enter but c'mon man... that kind of behavior.. If I were a cop and someone did that to me that might raise my eyebrow. I'd spend a little bit of effort looking into it. If I didn't, I wouldn't be doing my job.

Ummmm..... He had to climb out the window, or else a venerable skunk-fog would have engulfed both of them I'd imagine; I've been in the same situation. If you've ever grown mj you know what I'm talking about - even with powerful carbon scrubbers, when you near harvest time the smell is, well, mighty powerful.

Yea exactly.. I'm sure the cop knows what you're talking about too. THat's EXACTLY WHY climbing out the window onto the roof to meet him is suspicious. If you do that shit you're obviously trying to hide some shit from who's at the front door. DUH
He would have been better off just ignoring the cop and pretending he wasn't home.

yeah if it was harvest time most my friends you can smell it at the front door for sure.
my one friend had glad plug ins in like every fuckin outlet on full blast and still when his mom visits she's like it smells like pot every time no matter what he does.
