Defendant in meth lab case wants to suppress evidence

A WOMAN who was arrested after a car pullover yielded chemicals and items used for the manufacture of methamphetamine asked the District Court of Guam to suppress evidence seized from her and the statements she made during investigation, saying her right was violated.

A motion filed by Federal Public Defender John T. Gorman for Johnnie Fortner stated that the search conducted in her car, a Mazda Miata, was not proper because the driver, Joshua Ulloa, did not have the authority to consent to the search of her purses and bag.

Fortner said Ulloa, in fact, did not give the police permission to look into her purses and bag. She said there was no evidence that Ulloa had actual authority. She added that she did not authorize the driver to consent to the search.

Fortner pleaded not guilty to the charges of attempt to manufacture methamphetamine hydrochloride.

Fortner was arrested in October along with Ulloa and Christine Duenas after they were pulled over by police officers on South Diaz Road in Chalan Pago.

Prior to her arrest, her boyfriend, Kelly Francisco, was apprehended in a traffic stop at 12:40 a.m. the same day.

According to Special Agent Thanh Churchin of the U.S. Drug Enforcement Agency, Guam Police Officer B. Babauta and Sgt. James Santos conducted a traffic stop on a maroon 1997 Ford Explorer and identified the driver as Kelly Francisco.

Francisco was subsequently arrested with a methamphetamine pipe and a plate of methamphetamine which was approximately 0.1 gram.

When Francisco was transported to the Hagatna Police Precinct, he made a telephone call to Fortner and told his girlfriend that he just got arrested for drugs and asked her to come down and pick up his personal belongings. Believing that Francisco had made the telephone call to warn Fortner of his arrest and possibly destroy or remove evidence from Francisco’s residence, the call was then terminated by Officer G. Asprec.

Sgt. Santos went to Francisco’s residence where he saw a 1991 gray Mazda Miata. Twenty minutes later, he saw the Mazda leaving the residence but was subsequently stopped by police officers for swerving and defective equipment. The police pulled over the Miata along Maimai Road in Chalan Pago.

During a search on the vehicle, a large bag and two purses were found in the trunk. One of the purses contained a methamphetamine pipe. A large bag contained a can of Draino and a glass of cooking pot with a brownish red substance in its bottom. The glass cooking port was still hot.

Suspecting that the items are related to a clandestine laboratory, Sgt. Santos contacted certified law enforcement personnel to assist local police with the processing of the items that were found.

An SOI stated that between 3 a.m. and 3:30 a.m., he/she received a call from Fortner asking to pick her up from Francisco’s residence.

Fortner advised that Francisco was arrested with an unknown amount of narcotics and that Fortner needed to get out of the house. The SOI told agents that when she/he arrived at Francisco’s residence, Fortner was waiting outside the residence, had a backpack and a big purse which were placed in the trunk of the SOI’s vehicle.

The SOI stated that all the items in the trunk of his/her vehicle belonged to Fortner.

SOI2 confirmed to authorities what the first SOI stated, adding that there was a strong odor of chemical emanating from Fortner.

Agent Churchin declared in court that previous intelligence information identified Fortner’s involvement in the manufacture of crystal methamphetamine.

Agents and police officers seized from the Mazda Miata a plastic gallon jug half full with an acidic solution and red phosphorous; two 15-ml beaker with an oft-white residue, which field tested positive for methamphetamine; one 50-ml beaker with a brown residue which field tested positive for methamphetamine; one 30-mg red tablet of Sudafed; one 100-ml beaker with an oft-white residue which field tested positive for methamphetamine; a receipt for iodine; paper with what appeared to be a calculation for “ice” recipe; PH strips; a butane torch; a can of Draino; three scales; four different types of flasks; a red pot with red stains; two purses, one with an ID card for Fortner; and a bag with women clothing.

Agent Churchin added in his court declaration that another SOI stated that he was at the residence of Fortner and Francisco on Oct. 8 and saw assorted chemicals and items that appeared to be used for production of methamphetamine.

The third SOI stated that Francisco told him/her that there were enough products to produce 5 grams of methamphetamine.

How fortunate. After the cops visit the defendant's house because they suspect he may have warned his girlfriend, they just happen to be in a position to pull her over for "swerving" and "defective equipment."

Judging by the context (albeit poor grammar), Source of Information

and

afaik, they are called Confidential Informants (CI's) in most court cases
