So for my final paper of the semester in my law in society class I need to write an arguement paper about a topic chosen at random. The article that was chosen on random for me all has to do with Yage! How awesome is that, I get to write a 5 page paper on something I actually believe should be protected by the US Constitution as a religious right.... I dunno, I was just wondering what you folks think are some points that I should make to make this a good paper about it being protected as a religious right.

As I am familiar with it the biggest argument in the aya legality controversy is that the government must provide convincing evidence as a reason to step on first amendment rights.
If a group claims that a certain action is religious, the government must prove it is causing harm to others if they are going to illegalize it.

are you talking about yage, or dmt infused yage?
I almost couldnt pander about that subject for five pages, so I dont know how I can help you. I could pander for so long, but that would be a huge waist of time. Its all just too damn simple and to find facts and information is basically backtracking to the following point.
My lack of a response is due to the fact that I cant tell anyone how they need to practice any given religion, and the government shouldnt be able to either.
Some societies have assimilated to christianity, when their religions used to be all magic, spirituality, philosophy, and pure local tradition(with or without the use of psychedelics).
The best US based backup you have as far as the law goes are christian churches that use ayahuasca, or peyote. Mushrooms used by christains in south america. Then atleast somebody can fathom being on your side.
You dont want to be some hindue trying to make pot legal for religious use. That would be much harder to do.
Ayahuasca is illegal. The plants are not.
We should just count our blessings.
Its a fucked up subject, and if you want to write a really good short paper like that you need to research the hell out of these sects of christianity, and other religions.
I think all drugs should be legal, but not in the way that most freedom-happy people do.
So, I would have a hard time writing that paper.
It can be done though...........lol

Please mention at some point in your paper the absurdity of outlawing DMT as a schedule 1 substance given that we all walk around with it in our brains. We should outlaw serotonin next, since it is psychoactive.

I am supposed to use Gonzales v. O Centro Espirita Beneficiente Unia Do Vegetal as my reference for a case, I am gonna def say something about how we dont illegalize the importation of bananas and other fruits even though they contain DMT in them.... that was in the court case
