ebay question

my aunts cd player (pioneer pd-m403 6 disk changer) took a dump. the cd player fails to read the cds, & shuffles through the cartridge until "no disk" is read.
set in her old ways, she refuses to get any other cd player to go with her (matching) entertainment center. the cd player is old, they dont make them anymore.
so i turned to ebay. i purchases the same cd player off a buyer. this was his description:

I have some of the paperwork but cannot find the manual. I'm sure you can download one from the Pioneer website. The only problem is, i cannot find the remote control.
his return policy reads:

i received his cd player, took it to my aunts, hooked it up, & low n behold, this cd player is broken in the very same way as the old one!
i sent this email to the seller:

heres hoping hes a reputable guy and actually does returns...most likely because of his great rating...if not youre pretty much fucked i think...but dont worry ive lost more than $35 before

If you used paypal you should be able to start a refund claim if he doesn't just refund the money. Either way you'll probably have to send it back and cover the shipping charges so I don't know if it would be worth it since the shipping was more than the actual item.

if paypal follow their protocol. If they rule against you, dispute with the credit card company. To do the later, you should return the player w/ tracking so you can prove its returned.
I belive you have a legal right to a refund. This was sold as a cd player, the description implies certain warranties, such that it functions as a cd player

Maybe it's a problem with some other part of the system? It seems like a major coincidence that it would be broken the exact same way.

okay, so if i start a refund claim with paypal, as well as shell out more cash to ship it back, (lets say it costs $25 w/ tracking+shipping) thats a total of $59. & im only going to get a refund either the full initial amount ($34.) or just the $9.99 it costs for the player & no shipping refund?

looking more at other auctions of the same player, they give the same shady description of sorts.
similar malfunctions are not coincidences at all, its quite common. theres actually a term coined from it, i cant remember it at the moment =/
just like when playstation(?) released their new gaming consoles & the power supplies overheated the system resulting in massive recall.

Oh my god I can't believe Daryl has the fire chains that's a serious bitch! That was definitely one of the coolest things I have ever seen tripping!
I'm thinking that if you got a refund it might only be for the item price but I can't remember. I got a refund once and it took forever because pay pals dispute thing takes while, but I think I only got the item price back.
