Investigators Aren't Checking Logs of Meds Used to Make Meth

AUSTIN, Texas (AP) -- Two years after the Texas Legislature passed a law making it more difficult to buy over-the-counter cold medicines that contain a key ingredient used to make methamphetamine, many law-enforcement agencies say they don't have time to check logs stores use to record purchases.

The law, which went into effect in 2005, requires pharmacies to keep items containing pseudoephedrine behind pharmacy counters. Buyers must provide identification, and pharmacies must keep a record of sales of products containing pseudoephedrine and ephedrine for two years.

The law applies to several products, including Tylenol Sinus, Sudafed, Claritin-D, Advil Sinus, Alka-Seltzer Cold, Coricidin Cough & Cold and Dristan Sinus. The restrictions do not apply to liquid or gel forms.

Several Central Texas law-enforcement officials say they can't just punch in a name and see how often someone is buying the cold medicines in stores around Texas, the Austin American-Statesman reported in Sunday editions. The Legislature did not fund a centralized database.

Officer Veneza Aguinaga, a spokeswoman for the Austin Police Department, said there are simply too many stores for officials to check.

Still, state law-enforcement officials say the law has slashed meth lab production. They cite limits on how much of the medicines a person can buy and requirements that the drugs be kept behind the counter. A similar measure became federal law.

Many stores apparently no longer carry the medicines, in part because the state requires outlets that lack a pharmacy to pay a $600 registration fee for the right to sell the products for two years.

Out of 30,000 to 40,000 stores in the category, including convenience stores, only about 300 paid the fee, said Karen Tannert, chief pharmacist with the Drugs and Medical Devices Group at the Department of State Health Services.

"Prior to the ephedrine law, individuals that were manufacturing were going into the stores and were scooping the shelves clear," said Detective John Cottle of the Texas Department of Public Safety.

Seizures of Texas meth labs dropped by half from 2005 to 2006, said DPS spokesman Tom Vinger. From January to September of this year, just 33 meth labs were seized, compared with 103 for all of 2006. In 2002, Texas law enforcement seized more than 350 meth labs.

But that doesn't mean meth use is down.

Statewide, DPS reported that it seized 302 kilograms of meth during traffic stops in 2006 — up from 159 kilos the year before and 197 in 2004. The federal Drug Enforcement Administration saw its meth seizures in Texas jump from 813 kilos in 2004 to 1,054 in 2005, then down to 681 last year.

Law officers said meth from Mexico is filling the void created by the shutdown of Texas labs.

What a surprise. Apparently it just isn't feasible to check manually recorded purchasing information from every corner pharmacy and gas station in America. Who could have foreseen the sheer volume of data they would have to contend with. :rolleyes:

Aside from those stores which use a computerized database to record purchases I figured there would be little watching of these sales logs. It always seemed to me that their real utility would be after there all ready was a criminal investigation. Those logs would serve as just that much more damning evidence.
