A BUSINESSMAN who has been jailed for three years for possession of enough drugs to make 14,000 cannabis cigarettes had sponsored a booklet for children warning of the dangers of drugs and alcohol.
Thomas Smyth (28), with an address in Mullagh, Co Cavan, was described as one of the main drug dealers in Kells, Co Meath, for the past 10 years.
His barrister said Smyth had gone to great lengths to beat his own addiction to drugs.
He said his client had sponsored a local football club as well as the publication of two booklets for use in schools, including one on issues related to child protection, including bullying, alcohol and drug abuse, and safety.
But Judge Michael O'Shea told Trim Circuit Court that anyone found dealing in drugs should know there are serious consequences.
Dealing
Detective Sergeant Martin Barrins described Smyth as "one of the main people involved in drug dealing in the last 10 years around Kells".
Det Sgt Barrins told Trim circuit court that gardai searched a house Smyth owned at Cherryhill Road in Kells on January 15 last year and found 4oz of cannabis as well as a notebook containing names and figures. When Smyth heard they were also going to search a shed at the rear of a premises in Kells town, he said that anything that was in the shed had nothing to do with him.
The search revealed five 9oz bars of cannabis resin. When he was arrested and searched, gardai found a small amount of cocaine on him.
Debts
He claimed the names and figures related to debts he was owed but Det Sgt Barrins told State prosecutor Jonathan Kilfeather he instead believed they were details of "people who owed him money for drugs".
The drugs had a street value of €10,250 and were sufficient to make 14,000 cannabis cigarettes.
Smyth's barrister, Kevin Segrave, detailed how Smyth had gone to great lengths to beat his addiction to drugs and now runs a scaffolding business and employs four people.
He came to court with €5,000 in cash for donation to a drug-related charity the court nominated, he added.
Judge O'Shea said Smyth had been actively distributing cannabis "for profit and gain and doing so with his eyes open" and also while running a business.
The court heard Smyth has a number of assets, including two houses, a 2006-registered jeep, a speedboat and that he recently bought his fiancee a Mercedes car.
Mr Segrave objected to the evidence on his assets and said information had not been sought by gardai on Smyth's financial affairs.
Judge O'Shea imposed the three-year sentence on the single count before the court of unlawful possession of the drugs for the purpose of selling or otherwise supplying them to others.
At the request of the defence, he gave him two weeks to put his business in order before he must surrender himself to the prison authorities. As part of the two-week stay on the start of the sentence, Smyth must not dissipate any of his assets and must surrender his passport.
He is to present himself at Kells Garda Station on November 6 next to begin his sentence.

He's a good man. Can we now stop using the lame excuse that dealers are specifically trying to get our 10 year olds hooked to drugs by candy coating them and putting them in pretty packages?

A qp, and some hash... Sounds like a major smoker to me, not some huge dealer for 10 years. Hope he is spared from a hella sentence.
