A FATHER-OF-THREE has been cleared of rape after being accused of attacking a young woman at a birthday party.
Douglas Blakey, 39, was himself attacked with a snooker cue by the 21-year-old woman's lesbian partner following the alleged incident at his home in Sighthill.
Mr Blakey told the High Court in Edinburgh: "I had three big lumps on my head and a sore neck. I was concussed."
He added: "I didn't know what I was being hit for, really. I am not that kind of man."
The court heard how the two women went to Mr Blakey's flat for a birthday party in February this year.
The karaoke was so loud that neighbours complained.
Mr Blakey was drinking whisky and strong lager and smoking cannabis. His live-in lover had recently run out on him after 20 years together and he had just been told she was with a new man, the court heard.
Witnesses described him as staggering drunk.
At the end of the night the two women were invited to stay in Mr Blakey's former marital bed – the biggest in the house – and cuddled each other to sleep.
Mr Blakey was also in the room, looking at photos of his ex-partner on his computer, the court was told.
The 21-year-old described how she woke to find Mr Blakey on top of her, holding her wrists above her head and trying to have sex.
Defence advocate Michael Anderson asked why she had not screamed "long and loud". The woman told him: "I tried. I couldn't speak."
She described how she struggled to free one hand, then began nudging her sleeping partner in the back until she woke.
Mr Blakey told the court he had merely been trying to put on his pyjama trousers when he stumbled and fell on the bed.
"They both woke up screaming that I had been doing stuff to them and I never touched either of them," said Mr Blakey.
That was when the 27-year-old woman picked up the snooker cue which was beside the bed.

Clearly, everyone involved was making bad decisions.
